operational standards, and Quality assurance
overall quality assurance, and all safety,
design, and operational standards are
maintained to its satisfaction.
(B) Because the projects identified on
Schedule A for which the MDOT has
construction management responsibility are
only in the project planning stage, the
MDOT is authorized to transfer funds from
one project to another; provided, however,
that the State's total commitment to the
infrastructure construction costs shall not
exceed $26.8 million to complete all projects
for which the state has responsibility for
construction management as shown on
Schedule A. Funding of the $26.8 million for
which the state has construction
management responsibility may not be
increased by budget amendment or
otherwise. The MDOT may also provide a
grant of up to $26.8 million to the County for
the County to construct those roads for which
the MDOT has construction management
responsibility. If the State delegates
construction management responsibility to the
County, the County will also assume cost
overrun responsibility. Further provided that
the State will be responsible for the
maintenance of the Capital Beltway and State
Roads projects identified on Schedule A
regardless of the entity responsible for
constructing those infrastructure
improvements.
(C) The Secretary may provide a grant to
Prince George's County of up to $12.5
million for construction or improvements to
county roads that are not directly located on
the Wilson Farm property, exclusive of the
additional $26.8 million which the State may
also grant to the County for the purpose of
assuming construction management and cost
overrun responsibility for those roads for
which MDOT has construction management
responsibility. The grant shall be provided
only upon receipt from Prince George's
County of a written agreement to: (1) repay
