Ch. 136

(c)     (1) The purpose of the Program is to teach construction skills to students of
the Charles H. Hickey, Jr. School through participation in the renovation of the cottages
at the school to be renovated under the Phase II renovation contract.

(2) The construction skills to be taught in the Program may include framing,
electrical and plumbing work, tile installation, painting, sheetrock installation, concrete
work, and landscaping.

(d)     (1) Funds for this Program:

(i) Shall be distributed from the Juvenile Justice Capital Project

Fund; and

(ii) May not exceed [$150,000] $250,000 $400,000 IN TOTAL.

(2)     Funds NO MORE THAN $250,000 OF THE FUNDS for this Program shall
be used to pay:

(i) Students for actual work performed;

(ii) Part-time instructors for on-site supervision of student labor; and

(iii) Expenses relating to classroom instruction and materials.

(3)     Construction materials for this Program:

(i) Shall be provided through the Phase II renovation contract;

(ii) Shall be identified in the procurement documents for the contract;

and

(iii) May not exceed [$250,000] $150,000 in value.

(e)     (1) The Department may, in consultation with the Department of General
Services, contract with the company that is currently operating the Charles H. Hickey, Jr.
School to develop the Program.

(2)     The Program contract shall be developed on terms that are acceptable to
the Department and the Department of General Services, subject to the provisions of
paragraph (3) of this subsection.

(3)     The contract for the Construction Training Pilot Program at the Charles
H. Hickey, Jr. School shall include provisions that hold the State harmless from any
liability that may result from the Program, place full responsibility for any liability with
the contractor, and require full disclosure of any risks associated with the project to
project participants and their parents or guardians in advance of participation in the
project.

(f)     Notwithstanding any provision in this section, the Department of General
Services shall have the authority to inspect all work completed under the Program for
compliance with State building codes.

(g)     All actions taken under this Pilot Program shall be in compliance with § 3-213
of the Labor and Employment Article.
