Zoning Text Amendment No. 94009

AN AMENDMENT to the Montgomery County Zoning Ordinance for the purpose of

[[- Developing Interim Best Management Practices (BMP) performance and water
quality protection goals for storm water management, sediment and erosion
control facilities associated with projects developing in special protection areas,
and monitoring protocols;

-  Provide for developer-funded BMP monitoring, and collection and analysis of
monitored BMP data by the developer to help establish the range of effectiveness
for each and/or combined BMP facilities over time;

-  Develop a concurrent in-stream monitoring program as part of a comprehensive
water quality data base to assess in-stream impacts and stream use attainment,
and develop biocriteria;

-  Provide ongoing evaluation and upgrading of BMP design criteria based on the
degree of achievement of interim goals as verified through BMP and in-stream
monitoring;

-  Provide for increase bonding, sinking fund, or other financial requirements to
allow for continuing maintenance;

-  Develop new/innovative BMP's which would be more effective in a sustainable
manner over time;]]

[[- Determine thresholds for projects to be subjected to enhanced review
procedures; and

-  Provide for a reporting system from the Director to the Planning Board and
County Council highlighting the monitored results, any violations of interim goals,
remedial actions taken, recommended changes in BMP design, and progress
toward development of performance criteria, in-stream biocriteria, and related
revisions to stream use designations at the state or local level.]]

-  Creating definitions for terms associated with the water quality review

-  Requiring a water quality review for certain projects within a special protection
area

By amending the following sections of the Montgomery County Zoning Ordinance,
Chapter 59 of the Montgomery County Code:
