Laws of Montgomery County, 1994

AN ACT to:                                                                           

(1)     revise the definition of Moderately Priced Dwelling Unit (MPDU);

(2)     authorize the County Executive to adopt income eligibility standards that may
be different for MPDU purchasers and renters;

(3)     permit the occupant of a rental MPDU, which is later offered for sale, to buy
the unit in certain circumstances;

(4)' specify certain ratios of MPDU's to market-price or -rent dwelling units in
certain subdivisions;

[[(5) amend the requirements for producing MPDUs in planned development,
mixed use, and transit station zones;]]

(5)     revise the requirements for staging of MPDUs;

(6)     authorize the Department of Housing and Community Development to buy
certain MPDUs and sell them to certain persons;

(7)     authorize the Executive to adopt regulations governing the resale of certain
MPDUs;

(8)     authorize the Executive to establish certain marketing procedures for
MPDUs;

(9)     require that an owner of an MPDU must occupy the unit as his or her primary
residence, and authorize certain legal action to invalidate sales in violation of
this Chapter or recover rents paid to an MPDU owner in violation of this
Chapter, and to otherwise enforce this Chapter;

(10)   clarify provisions related to foreclosure sales of MPDUs; and

(11)   generally amend the law regulating MPDUs.
