PARRIS N. GLENDENING, Governor                            H.B. 204

(1994 Replacement Volume and 1994 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health - General

3-303.

(A)    If a health officer [or deputy of a health officer] is a physician, the health
officer [or deputy] may not:

(1) Practice medicine, except in the performance of any official duties; or

(2) Engage in [any] AN occupation that conflicts with the performance of
any official duties.

(B)     IF A DEPUTY OF A NONPHYSICIAN HEALTH OFFICER IS A PHYSICIAN AS
REQUIRED BY § 3-302(D) OF THIS SUBTITLE, THE DEPUTY MAY PRACTICE MEDICINE
IN ADDITION TO THE PERFORMANCE OF THE DEPUTY'S OFFICIAL DUTIES.

3-303.

(A) If a health officer or deputy of a health officer is a physician, the health officer or
deputy may [not:

(1)     Practice medicine, except in the performance of any official duties; or

(2)     Engage in any occupation that conflicts with the performance of any official
duties.] PRACTICE MEDICINE AS LONG AS THE LOCAL GOVERNING BODY SEEKS AND
RECEIVES APPROVAL FROM THE SECRETARY
WITH THE APPROVAL OF THE LOCAL
GOVERNING BODY.

(B) THE LOCAL GOVERNING BODY SHALL NOTIFY THE SECRETARY OF ITS
APPROVAL.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1995.

vetoed House Bill 204.

This bill alters the method of selecting members to the Calvert County Board of
Education by requiring one member to be elected from each of the three County
