Article - Real Property

11A-121.

(g) A developer shall maintain all records of trust money, as defined in rSubtitle
5 of the Maryland Real Estate Brokers Act] TITLE 17, SUBTITLE 5 OF THE BUSINESS
OCCUPATIONS AND PROFESSIONS ARTICLE, in a secured area within the office of the
developer.

DRAFTER'S NOTE:

This section and Section 5 of this Act are intended to correct errors in Senate
Bill 10 of 1995.

SECTION 4. AND BE IT FURTHER ENACTED, That the changes made to
Article 2B, § 9-203, Article 88A, § 45(c), and § 11A-121(g) of the Real Property Article

by Chapter____(S.B. 10) of the Acts of the General Assembly of 1995 may not be given

effect and the changes made to those provisions by Section 3 of this Act shall prevail,
regardless of the date of final enactment.

SECTION 5. AND BE IT FURTHER ENACTED, That changes to
cross-references of sections of the Business Occupations and Professions Article, made
by the Michie Company pursuant to Section 13 of Chapter 3 of the Acts of the General

Assembly of 1994 (as amended by Section 7 of Chapter____(S.B. 10) of the Acts of the

General Assembly of 1995 and printed in the 1994 Cumulative Supplement of the
Business Occupations and Professions Article, are hereby validated.

SECTION 6. AND BE IT FURTHER ENACTED, That Section 8 of Chapter

____(S.B. 10) of the Acts of the General Assembly of 1995 may not be given effect and

Section 5 of this Act shall prevail, regardless of the date of final enactment.

SECTION 7. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:

Article - Tax - General

12-104.

(b) The tobacco tax does not apply to cigarettes that:

(1) a [person] LICENSED WHOLESALER UNDER TITLE 16 OF THE
BUSINESS REGULATIONS ARTICLE is holding for sale outside the State or to a United
States armed forces exchange or commissary;

DRAFTER'S NOTE:

Dr. Charles Ehart, Administrator, Alcohol and Tobacco Tax Unit of the
Office of the Comptroller, advised that the language is needed for clarification
of the subsection.

SECTION 3. 8. AND BE IT FURTHER ENACTED, That the Drafter's Notes
contained in this Act are not law and may not be considered to have been enacted as part
of this Act.
