SECTION 4. 9. AND BE IT FURTHER ENACTED, That this Act is an
emergency measure, is necessary for the immediate preservation of the public health and
safety, has been passed by a yea and nay vote supported by three-fifths of all the members
elected to each of the two Houses of the General Assembly, and shall take effect from the
date it is enacted.

AN ACT concerning
Smoking—Prohibition on Adoption of Regulations to Restrict Smoking Smoking in the
Workplace
FOR the purpose of prohibiting providing that, notwithstanding any regulations adopted by
the Secretary of Licensing and Regulation and the Commissioner of the Division of
Labor and Industry from proposing or, adopting, or enforcing any regulation that
restricts smoking, the smoking of or possessing certain tobacco products is permitted
in certain locations under certain circumstances; authorizing the Secretary and
Commissioner to adopt certain regulations under certain circumstances; providing
for the application of this Act; providing that this Act shall be construed
retroactively and shall be applied to and interpreted to affect the enforcement of
certain previously adopted regulations; providing that this Act is not intended to
preempt certain authority of counties and municipalities; making this Act an
emergency measure; and generally relating to the regulator)' authority of the
Secretary and Commissioner under certain circumstances smoking of tobacco
products in certain work places.
