Ch. 3                                       1995 LAWS OF MARYLAND

State government by Chs. 165 and 166, Acts of 1994, to reflect the status of the
head of the Department as a Secretary of a principal department of State
government, and to delete surplus language.

24-111.2.

The DEPARTMENT OF [Maryland] State Police shall maintain at least five vehicle
weighing and measuring stations. At least one of these stations shall be on United States
Route I-95.                                 

DRAFTER'S NOTE:                                     

This section is amended to reflect the establishment of the Department of
State Police as a principal department of State government by Chs. 165 and
166, Acts of 1994 and to delete surplus language.

24-113.

(b). The State Highway Administration and the DEPARTMENT OF [Maryland]
State Police jointly may formulate rules and regulations that:

(1)     Implement the statutes on the movement of oversize and overweight
vehicles; and

(2)     Establish fees and charges under these statutes.
DRAFTER'S NOTE:

Subsection (b) of this section is amended to reflect the establishment of the
Department of State Police as a principal department of State government by
Chs. 165 and 166, Acts of 1994 and to delete surplus language.

25-111.

(a) (2) "Hazardous materials inspector" means a person who is assigned by the
DEPARTMENT OF the Environment and certified by the Department of [Maryland]
State Police to perform an inspection authorized under this section.

(3)     "Police officer" means:

(i) Any uniformed law enforcement officer;

(ii) Any civilian employee of the DEPARTMENT OF [Maryland] State
Police assigned to enforce any rule or regulation adopted under this section, but only
while acting under written authorization of the [Superintendent] SECRETARY of the
[Maryland] State Police;

(iii) Any civilian employee of the Maryland Transportation Authority
Police who is:

1. Acting under the immediate direction and control of a
uniformed police officer;
