DRAFTER'S NOTE:

This section is amended to reflect the establishment of the Department of
State Police as a principal department of State government by Chs. 165 and
166, Acts of 1994, to make a clarifying change, and to delete surplus language.

24-106.2.

(c) The fastening of a load to a vehicle shall be:

(2) If they have at least as much tensile strength as the chains, by:

(iv) Any fastening device specified in regulations adopted jointly by the
Administration and the DEPARTMENT OF State Police; or

DRAFTER'S NOTE:

Subsection (c)(2)(iv) of this section is amended to reflect the establishment of
the Department of State Police as a principal department of State government
by Chs. 165 and 166, Acts of 1994.

24-111.

(a)     In this section and in § 24-111.1 of this subtitle, "police officer" means:

(1)     Any uniformed police officer;

(2)     Any civilian employee of the DEPARTMENT OF [Maryland] State
Police assigned to enforce this subtitle, but only while acting under written authorization
of the [Superintendent] SECRETARY of the [Maryland] State Police; or

(3)     Any civilian employee of a local government who is:

(i) Acting under the immediate direction and control of a uniformed
police officer;

(ii) Acting under written authorization of the [Superintendent]
SECRETARY of the [Maryland] State Police; and

(iii) Certified by the DEPARTMENT OF [Maryland] State Police to
perform the weighing and measurement authorized under this section.

(b)     (2) The weighing authorized by this subsection:

(i) May be done with either portable or stationary scales; and

(ii) In either case, shall be done by methods established by experts in
the field of weights and measures and adopted by rule or regulation of the DEPARTMENT
OF [Maryland] State Police.
