2.       Acting under the written authorization of the
[Superintendent] SECRETARY of the [Maryland] State Police;

3.       Certified by the DEPARTMENT OF [Maryland] State Police
to perform an inspection authorized under this section.

(iv) Any civilian employee of a local government who is:

1.       Acting under the immediate direction and control of a
uniformed police officer;

2.       Acting under the written authorization of the
[Superintendent] SECRETARY of the [Maryland] State Police; and

3.       Certified by the DEPARTMENT OF [Maryland] State Police
to perform an inspection authorized under this section.

(4) "Public Service Commission inspector" means a person who is assigned
by the Public Service Commission and certified by the DEPARTMENT OF [Maryland]
State Police to perform an inspection authorized under this section.

(b) (2) A police officer who is certified by the DEPARTMENT OF [Maryland]
State Police to perform an inspection authorized under this section, a Public Service
Commission inspector, or a hazardous materials inspector may conduct a safety
inspection of the vehicle that is subject to a rule or regulation adopted under this section
or § 22-409 of this article.

(f) (2) Any rule or regulation adopted pursuant to this subsection shall:

(i) Be formulated jointly by the MOTOR VEHICLE Administration and
the DEPARTMENT OF [Maryland] State Police;

DRAFTER'S NOTE:

Subsections (a)(2), (3), and (4), (b)(2), and (f)(2)(i) of this section are
amended to reflect the establishment of the Department of State Police as a
principal department of State government by Chs. 165 and 166, Acts of 1994,
to reflect the status of the head of the Department as a Secretary of a
principal department of State government, and to delete surplus language.

(d) "Police department" means:

(1) The DEPARTMENT OF [Maryland] State Police;

DRAFTER'S NOTE:

Subsection (d)(1) of this section is amended to reflect the establishment of the
Department of State Police as a principal department of State government by
Chs. 165 and 166, Acts of 1994 and to delete surplus language.
