Section 14-401(b)
Annotated Code of Maryland
(1994 Replacement Volume)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

ArticleHealth Occupations

14-411.

(p) IF THE BOARD DISCIPLINES A PHYSICIAN FOR AN ACT OR BEHAVIOR OF
THE PHYSICIAN IN TREATING A PATIENT, THE BOARD SHALL DISCLOSE TO THE
PATIENT OR THE PATIENT'S HEIRS OR REPRE
SENTATIVES THE INFORMATION
CONTAINED IN A RECORD THAT RELATES TO THE DISCIPLINARY ACTION;

(Q) If any information contained in any medical or hospital document or any other
exhib
it is otherwise open for disclosure under law, the use of that document or exhibit in
any record of the
Board or any of its investigatory bodies does not prevent its disclosure
in any oth
er proceeding.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section(s) 14-401(b) through (h), respectively, of Article - Health
Occupations of the Annotated Code of Maryland be renumbered to be Section(s)
14-401(c') through (i), respectively.

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:

14-401.

(B) IF AN ALLEGATION OF GROUNDS FOR DISCIPLINARY OR OTHER ACTION
IS MADE BY A PATIENT OR A FAMILY MEMBER OF A PATIENT IN A STANDARD OF
CARE CASE
AND A PRELIMINARY FULL INVESTIGATION RESULTS FROM THAT
ALLEGATION, THE PRELIMINARY FULL INVESTIGATION SHALL INCLUDE AN OFFER
OF
AN INTERVIEW WITH THE PATIENT OR A FAMILY MEMBER OF THE PATIENT WHO
WAS PRESENT ON OR ABOUT THE TIME THAT THE INCIDENT THAT GAVE RISE TO
THE ALLEGATION OCCURRED.

SECTION 2. 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1995.
