305. a Justice of the Peace of the State of Maryland for the said County, and acknowledges the same to be her act and deed for the purposes within mentioned. Acknowledged before Charles Corkran J. P. John T. Stewart Be it remembered & it is hereby certified that the Ex.d from 105 following Mortgage Bill of Sale was recorded on the Robert B. Hazzard 27.th day of December A. D. 1850, To wit: This Indenture made this twenty seventh day of December in the year of Our Lord Eighteen hundred & fifty, between Robert B. Hazzard of Dorchester County & state of Maryland, of the one part, and John T. Stewart of Dorchester County and State aforesaid, of the other part Whereas the said Robert B. Hazzard owes & stands justly indebted to the said John T. Stewart in the sum of forty six dollars, current money, and to secure the payment thereof is willing to execute these presents: Now this Indenture Witnesseth that the said Robert B. Hazzard, for and in consideration of the premises, and for and in consideration of the sum of two dollars, current money, to him in hand paid by the said John T. Stewart, at or before the sealing & delivery of these presents, the receipt whereof the said Robert B. Hazzard doth hereby acknowledge, and thereof & therefrom doth acquit, release, exonerate & forever discharge the said John T. Stewart, his heirs, executors & Administrators and every of them by these presents, hath granted, bargained & sold, and by these presents doth grant, bargain & sell, unto the said John T. Stewart, his executors, Administrators and Assigns all & singular the herein after particularly mentioned & expressed (that is to say) one Crop of wheat purchased by the said Robert B. Hazzard of Stephen Barnes, being the Crop of wheat seeded by the said Stephen Barnes on the Farm at present occupied and rented by him of M.rs Eliza Kerr, also one pied white and red Cow purchased by the said Hazzard of Levin D. Botham. To have and to hold all & singular the said Crop of wheat & white & red pied Cow herein before granted, bargained & sold, or mentioned or intended so to be, unto the said John T. Stewart, his executors, Administrators & Assigns, to the only proper use & behoof of the said John T. Stewart, his executors, Administrators & Assigns, forever: Provided Always, and these presents are upon this condition, that if the said Robert B. Hazzard, his executors or Administrators, shall & do well & truly pay or cause to be paid, unto the said John T. Stewart, his executors, Administrators, or Assigns, the full sum of Forty six dollars, current money, with legal interest for the same, on or before the first day of July in the year of Our Lord Eighteen hundred & fifty one, then & in such case these presents, and every matter & thing herein contained, shall cease, determine & be utterly void, to all intents & purposes, any thing herein contained to the contrary thereof in anywise notwithstanding And the said Robert B. Hazzard for himself his heirs executors or Administrators, or some or one of them, shall & will well & truly pay or cause to be paid unto the said John T. Stewart, his executors, Administrators & Assigns, the said sum of Forty six dollars, together with interest for the same, at such time as in |
