283 Mitchell and Thomas J. Dail of same County & State of the other part Whereas the said William Wherritt owes and stands justly indebted to the said Capt. Shadrach Mitchell in the sum of one hundred & twenty dollars, and the said Thomas J. Dail in the sum of Seventy three dollars and thirty nine cents, current money, and to secure the payment thereof is willing to execute these presents. Now this Indenture Witnesseth that the said William Wherritt, for and in consideration of the premises and the further sum of one dollar to him in hand paid by the said Mitchell and Sail, at or before the sealing & delivery of these presents, the receipt whereof the said William Wherritt doth hereby acknowledge, and himself to be therewith contented and paid, the said William Wherritt has given, granted, bargained and sold, and by these presents does give, grant, bargain and sell unto the said Mitchell & Dail, their executors, Administrators and Assigns, all and singular the goods, furniture and house hold stuff herein after particularly mentioned and expressed, that is to say 4 Beds and furniture, 1 Side Board, 1 Bureau, 3 Tables, 3 Stands, 14 Chairs, 2 Rocking Chairs, 2 Stools, 2 p.r Brass & 1p.r of Iron Andirons, 2 Shovel and tongs, 2 Carpets, 1 Lathe & fixtures, Work Bench, Grindstone, one Mantle Clock, balance of Household & Kitchen furniture. To have and to hold all and singular the said goods herein before granted, bargained & sold, or mentioned or intended hereby so to be, unto the said Capt. Shadrach Mitchell and Thomas J. Dail, their executors, Administrators and Assigns forever: Provided Always and it is the true intent and meaning of these presents and of the parties hereunto that if the said William Wherritt, his executors or Administrators shall and do well & truly pay or cause to be paid unto the said Mitchell & Dail, their executors, Administrators & Assigns their respective claims, with legal interest for the same, on or before the first day of January 1851, then and in such case these presents and every matter and thing therein contained shall cease, determine and be utterly void to all intents & purposes, any thing herein contained to the contrary thereof in any wise notwithstanding. In testimony whereof I hereunto subscribe my hand and affix my seal the day and year first herein before written. his Signed, sealed & delivered in the William x Wherritt (seal) presence of Noah Abbott J. P. mark State of Maryland, Dorchester County, Sct: Be it remembered and it is hereby certified that on this Eleventh day of October 1850, before the subscriber, a Justice of the Peace of said State, in & for Dorchester County aforesaid, personally appeared William Wherritt, he being known to us to be the person who is named and described as, and professing to be a party to the foregoing Mortgage, and doth acknowledge the same to be his Act and deed: And at the same time also appeared before me, Capt. Shadrach Mitchell and Thomas J. Dail the Mortgages and made Oath that the considerations set forth in said Mortgage are true and bona fide as therein set forth. Acknowledged & sworn before Noah Abbott J. P. Mortgage Deed delivered to Tho J Dail July 10th 1853. |
