205 four several notes of hand, as aforesaid, when due, or of the interest which shall accrue thereon, or any part thereof at the time limited for the payment of the same, then these premises are upon this further trust and it is hereby agreed that the said Thomas B. Travers, his Executors, Administrators or Assigns may, and ^he^ they are hereby authorised to sell the above Mortgaged Schooner called the Sophia Delia of Oxford, with all her tackle & apparrel, and all the right, title, interest, property, claim & demand, at law & in equity, as well of the said Thomas B. Travers as of the said Thomas Abbott & Samuel Abbott, and all then claiming by, from or under each of them, in & to the said Mortgage Schooner called Sophia Delia of Oxford, by public Auction to the highest bidder for Cash, after first giving twenty days notice by Advertisement inserted in some news paper published in Dorchester County aforesaid, and after giving the said twenty days notice of the time, place, manner & terms of sale, and after making any such sale and receiving the purchased money thereof agreeable to the terms of sale, to convey the property, or said Schooner called the Sophia Delia of Oxford so sold, by a good & sufficient Bill of sale to the purchaser or purchasers, his, her or their heirs or Assigns, as fully & effectually as the said Thomas Abbott & Samuel Abbott might or could have sold and conveyed the said Mortgaged Schooner immediately before the execution of these presents, any thing herein to the contrary thereof in any wise notwithstanding. In Witness whereof the said Thomas Abbott and Samuel Abbott has hereunto set their hands & seals on the day and year first above written. Signed, sealed & delivered in the presence of Thomas H. Abbott (seal) John W. Travers Edward C. Simmons Samuel K. Abbott (seal) Maryland, Dorchester County, To wit: Be it remembered that on this eighteenth day of September 1849, before me the subscriber a Justice of the Peace of the State of Maryland, in & for said County, personally appeared Thomas Abbott, Samuel Abbott and acknowledged the above and foregoing Mortgage Bill of sale or instrument of writing to be their Act & deed for the purposes therein mentioned Also same time personally appeared Thomas B. Travers, grantee of the said instrument, and made Oath on the Holy Evangely of Almighty God that the consideration set forth in the above and foregoing Mortgage Bill of sale or instrument of writing is true & bona fide as therein set forth. Acknowledged before & certified by John W. Travers Received 25.th September 1849 from Thomas B. Travers the sum of Twenty five cents in lieu of a stamp on this Mortgage Bill of sale.
