35 the aforesaid sum of money advanced by him and in them to secure and indemnify the said Ann M Byers from any and all damages and loss arising out of his being security as aforesaid for the said William S Byers Now this Indenture witnesses that the said William S Byers in consideration of the premises and also the further sum of ten dollars in hand paid this day by the said Henry Page and Ann M Byers has bargained and sold and does by these presents bargain and sell to the said Henry Page and Ann M Byers their heirs and assigns the following property to wit Negro man Tom, Negroes Daniel Dennis Maria and negro child maria, the crop of wheat now seeded one hundred and fifty barrels of corn five horses, two colts, two sheep, forty two hogs, two horse carts one ox cart seven ploughs four seed harrows one drag harrow five thousand pounds of black fodder; one fodder house seval stacks of wheat and oat straw corn caps one four wheat carriage two beds bedsteads and furniture two pair of andirons one iron fender two pairs of shovels and tongs two carpets two dozen chairs one dinner set of china one tea set of china two sets of Knives and forks one dozen tea spoons one silver ladel one half dozen desert spoons two hearth rugs two hundred and fifty bushells of Irish potatoes fifty bushells of oats one corn sheller one what face one threshing machine and appurtenances and all the remainder of the personal estate of the said William S Byers to have and to hold the said personal estate to the said Henry Page and Ann M Byers their heirs and assigns as tenants in common Provided nevertheless and it is the true intent and meaning of these presents and of the parties thereto that if the said William S Byers shall ^pay^ or secure to be paid to the Henry Page his heirs or assigns the said sum of five hundred and eighty eight dollars and sixty cents ($588.60 cts) with interest from this date on or before the first day of January (1844) eighteen hundred and forty four which is intended and assigned by the parties to be first paid as a preference debt and shall also save harmless and indemnify the said Ann M Byers security as aforesaid then this Indenture shall be void and void else to remain in full force and effect in Case I testimony of which the said William S Byers has hereto set his hand and seal the day and year first above written Signed sealed and delivered in my pressence W.
