194. day of September Anno Domini Eighteen hundred and forty two with legal Interest for the same and in and by the said Obligations or notes of hand reference to the same being had will more fully and at large appear Now this Indenture Witnesseth that the said Francis Webb as well for and in consideration of the aforesaid debt of one thousand Dollars and for the better bearing the payment thereof, with Interest thereon unto the said Mrs Hester Handley her Executors Administrators and Assigns in discharge of the said Obligations Notes of hand or writings obligatory as for the father Sum of one Dollar to him in hand paid by the said Mrs Hester Handley at and before the Sealing and delivery hereof the receipt whereof is hereby Acknowledged hath granted bargained Sold Aliened and confirmed and by these parties doth grant bargain Sell release and confirm unto the said Mrs Hester Handley her heirs and assigns all the Crop of Wheat oats and corn which is now seeded and growing on the Farm whereon he the said Francis Webb now resides also all the Corn Caps potatoes or other produce which may be hereafter sown planted and cultivated and raised and grown thereon with all the wood which may be cut and prepared for market from the time hence till the aforesaid obligations notes of hand or writings obligatory shall have been discharged & paid and fully satisfied and contented To Have and to Hold the said Crops of wheat, oats, corn, potatoes and wood unto the said Mrs Hester Handley her heirs and assigns to the only proper use and behoof of the said Mrs Hester Handley her heirs and assigns forever. Provided always nevertheless that if the said Francis Webb his heirs executors or Administrators shall and do well and truly pay or cause to be paid unto the said Mrs Hester Handley her executors Administrators or assigns the aforesaid steve or Sum of one thousand Dollars on the day or days or times herein before mentioned and appointed for payment thereof with the lawful Interest for the same according to the terms or conditions of the aforesaid obligations Notes of hand or writing obligatory without any fraud or further delay and without any deduction defalcation or abatement whatsoever then and from thenceforth as well this partial Indenture and the Goods chattels and effects as the aforesaid obligations Notes of hand or writings obligatory shall cease determine and become utterly Null and Void to all intents and purposes any thing herein before contained to the contrary notwithstanding. In Witness whereof the said Francis Webb has hereunto set his hand and affixed his Seal on the day and year first above and aforegoing written Francis Webb (Seal) Signed Sealed and delivered in the presence of Geo A Z Smith Dorchester County State of Maryland Sct On this twenty Eighth day of February Anno Domini Eighteen hundred and forty four before the Subscriber a Justice of the peace in and for the County and State afs.d Personally appeared Francis Webb who acknowledged the aforegoing and above deed of Indenture to be his Act and deed according to the true intent and meaning thereof and according to the Acts of Assembly in such cases made and provided and that the goods chattels and effects therein mentioned and described to be the proper goods chattels and effects of the said Mrs Hester Handley Taken and Acknowledged before Geo A Z Smith |
