134 said Thomas Jones is justly indebted to the said James A Stewart in the sum of seven hundred and twenty three dollars & eighty two cents for & on account of Two Judgments in Dorchester County Court one at the suit of Charles Jones use of s.d Stewart rendered april 10th 1840 for the sum of Five hundred dollars with interest from date the other at the suit of Catharine Jones use of James A Stewart rendered april 14th 1840 for one hundred dollars & fifty cents with interest form date & costs $13.26 2/3 and to better securing the payment of the said debt is willing to execute these presents Now this Indenture witnesses that the said Thomas Jones for & in consideration of the premises & of the sum of one dollar to him in hand paid by the said Jas A Stewart at & before the sealing and delivery of these presents has granted bargained & sold & by these presents does grant bargain & sell unto the said James A Stewart his executors administrators & assigns all and singular the property following to wit One negro boy slave named "Bill, one other boy named "Joe" one other named "John" one negro girl named "Mary" one negro girl named "hester" Two head of horses & one colt Three oxen seven head of cattle ten head of sheep thirty head of hogs all his farming utensils all of his personal property of every description To have & to hold all & singular the said property which is now in the possession control & management of the said Thomas Jones & which is legally & rightfully his property unto the said James A Stewart his executors administrators & assigns to his & their own use & behoof Provided always & it is declared to be the true intent of these presents that this Instrument of writing is not in any manner or shape to effect the right of said Stewart to proceed in any way which he could resent to anterior to this under & by virtue of the said Judgments to to collect the same at any time but wherever collected this of course to be void and from and also that if the said Thomas Jones shall well & truly pay or cause to be paid unto the said James A Stewart his executors admrs or assigns the amount of the said Judgments with interest on the same on or before the first day of September next then this Instrument shall cease & be void to all intents & purposes otherwise of full force & virtue in law Witness my hand & seal this above day Test Thomas Jones (seal) Charles Corkran Dorchester County to wit On this 14th of June 1843 personally appeared before me the subscriber a justice of the peace for said county Thomas Jones grantor in the foregoing instrument of writing and acknowledged the same to be his act and deed for the purposes therein mentioned Charles Corkran |
