128 Maryland Dorchester County sc Personally appears Aaron Cook before me the subscriber a justice of the peace for Dorchester county and acknowledges the above to be his act and deed may 20 1843 James Read June 20.th 1843 Delivered to Capt Isaac Phillips W. J. 3.d James Hooper & Sons Be it remembered that the following Mortgage was recorded Paid from Ex.d 1st June 1843 to wit United States of America State of James Smith Maryland to wit Know all men by these presents that whereas James Smith of Dorchester county State of Maryland is owner of the schooner or vessel Called Benjamin Le Compte of Oxford of the burthen of 52 & 5 Tons or thereabouts and whereas the said James Smith is indebted to James Hooper John P Hooper & James Hooper Jr all of Baltimore merchants and copartners trading there under the firm of James Hooper & Sons in the sum of seven hundred 2/100 Dollars for which he the said James Smith has given to the said James Hooper & sons the three following Promissory Notes that is to say James Smiths note for four hundred 82/100 Dollars dated 31 May 1843 payable one Day after date to James Hooper & sons Smith & Deans note for Two hundred & six 38/100 Dollars dated 22d Decr 1841 payable Four Months after date to James Hooper & sons and James Smiths note for Ninety two 93/100 Dollars dated 31 may 1843 payable one Day after date to James Hooper the payment of which three Promissory notes he the said James Smith is desirous of securing by pledging to the said James Hooper & sons the said schooner Benjamin Le Compte and appurtenances Now Know Ye that I the said James Smith in consideration of the premises and the further consideration of the sum of One Dollar to me in hand paid at the time of the perfection of these presents by the said James Hooper & sons the receipt whereof is hereby acknowledged have granted bargained sold assigns transfered and set over and by these presents do grant bargain sell assign transfer and set over unto the said James Hooper John P Hooper and James Hooper Jr their executors administrators and assigns all that the said schooner or vessel called the Benjamin Le Compte of oxford together with all and singular her masts yards sails Rigging Anchors Cables boats tackle Apparel and appurtenances as she now lies in the Port of Baltimore and is more particularly described in a Certi of Enrolement granted her at the port of Oxford in the following words Enrolment Permanent "no. 39. Thirty Nine Enrolement in Conformity to an act of the Congress of the United States of America entitled "An act for enroling and licensing ships or vessels to be employed in the Coasting Trade and Fisheries (Seal) and for regulating the same" James Smith of Dorchester County & State of M to having taken or subscribed the oath required by the (Seal) said Act and having Sworn that he is a Citizen of the United (of the) States sole Owner of the ship or vessel called the Benjamin (Collector) Le Compte of Oxford whereof John W Dean is at present Master and (of the port of) as he hath sworn is a citizen of the United States and that the said (Oxford) ship or vessel was built in the County and state aforesaid during Nichs Willis Colltr |
