120 said notes of hand or bills obligatory the said Samuel Webb and James N Sherman did become sureties by an din complyance with the request and solicitations of the aforesaid Francis Webb and the said Francis Webb being desirous to secure and save the said Samuel Webb and James N Sherman against all responsibility as Justices of the said notes as aforesaid mentioned or described or either or any of them therefore this Indenture witnesseth that the said Francis Webb as well for and in consideration of securing the said sureties from the payment of the notes aforesaid or from the payment of any or either of them or any part of any or either of them as the sum of five dollars to him in hand paid by the said Samuel Webb and James N Sherman at and before the sealing and delivery thereof the receipt whereof is hereby acknowledged hath granted bargained sold and delivered and by these presents doth grant bargain sell and deliver unto the said Samuel Webb and James N Sherman their executors administrators and assigns all and singular the goods furniture and house hold stuff hereinafter particularly mentioned and expressed that is to say all of the cord or other wood or timber now cut and ready for market lying and being on the farm wherein the said Francis Webb now resides all the crop of wheat and oaths now seeded thereon one negro boy John one negro girl Judy five head of horses three yoke of oxen forty two head of cattle thirty four head of sheep twenty one head of hogs two ox carts five ox yokes seven ploughs and gear five harrows and gear four scythes and cradells one grass scythe four cutting axes two wedges two pitch forks one cutting box one wheat fan one corn cradle one lot sweet potatoes at C. Brambles one Gig & harness one Bureau twelve chairs one sink stand one lot dinner and one lot tea ware one lot Knives and forks two mahogany tables five beds bedsteads and furniture and all the rest of the house hold and Kitchen furniture one thousand pounds of bacon more or less twenty barrels of corn more or less one lot of blade fodder three bee hives fifty pounds of lard more or less one bridle and sadle one lot of spades and hoes one Grindstone one cross cut saw one lot of carpenters tolls and all the poultry of every Kind and quality that are on the farm To have and to hold all and singular the said goods negroes furniture house hold and Kitchen stuff herein before granted bargained and sold or mentioned or intended so to be unto the Samuel Webb and James N Sherman their executors administrators and assigns to the only proper use and behoof of the said Samuel Webb and James N Sherman their executors administrators and assigns forever provided always and these presents are upon this condition that if the said Francis Webb his executors or administrators shall and do well and truly pay or cause to be paid the aforesaid described notes or bills obligatory at or before they shall respectively become due and payable or by other lawfull means save Keep harmless and indemnified the said Samuel Webb and James N Sherman their heirs executors and administrators from the payment of the said notes or from the payment of any one of them or any part of them or one of them and all costs damages or charges as sureties aforesaid then and from thence forth as well this present indenture and the property hereby granted as the said recited obligation shall cease |
