PART II. THREE PERCENT LIMITED ADJUSTMENT.

29-404. SCOPE OF PART.

(A)     APPLICATION.

EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, THIS PART II OF
THIS SUBTITLE APPLIES ONLY TO AN ALLOWANCE RECEIVED BY A FORMER
MEMBER, RETIREE, OR SURVIVING BENEFICIARY OF A DECEASED MEMBER,
FORMER MEMBER, OR RETIREE OF:

(1) THE EMPLOYEES' PENSION SYSTEM;

(2) THE LOCAL FIRE AND POLICE SYSTEM;

(3) THE NATURAL RESOURCES PENSION SYSTEM; OR

(4) THE TEACHERS' PENSION SYSTEM.

(B)      EXCEPTIONS.

THIS PART II OF THIS SUBTITLE DOES NOT APPLY TO AN ALLOWANCE THAT IS
SUBJECT TO ADJUSTMENT UNDER PART III, PART IV, OR PART V OF THIS SUBTITLE.

REVISOR'S NOTE: Subsection (a) of this section is new language derived without
substantive change from former Art. 73B, §§ 4-413(b)(6), 5-412(b)(6),
8-405(a)(7), and 10-221(a)(7), and as they related to a description of which
allowances were subject to the adjustment in this Part II of this subtitle, §§
4-413(a) and (b)(1), 5-412(a) and (b)(1), 8-405(a)(1), and 10-221(a)(l).

Subsection (b) of this section is new language added to clarify that this Part II
does not apply to allowances that are subject to adjustment under Parts III,
IV, and V of this subtitle.
