1994 LAWS OF MARYLAND

(I)       THE CORRECTIONAL OFFICERS' RETIREMENT SYSTEM;

(II)     THE EMPLOYEES' PENSION SYSTEM;

(III)    THE EMPLOYEES' RETIREMENT SYSTEM;

(IV)    THE LOCAL FIRE AND POLICE SYSTEM;

(V)     THE NATURAL RESOURCES PENSION SYSTEM; AND

(VI)    THE TEACHERS' PENSION SYSTEM.

(2) THE PENSION OF A RETIREE WHO IS RESTORED TO MEMBERSHIP
AFTER AGE 50 MAY NOT EXCEED THE SUM OF:

(I) THE PENSION RECEIVED IMMEDIATELY BEFORE THE
RETIREE'S LAST RESTORATION TO MEMBERSHIP; AND

(II)     THE PENSION THAT ACCRUED AFTER THE RETIREE'S LAST
RESTORATION TO MEMBERSHIP.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, §§ 2-404(f)(2) and (g), 3-404(f)(7) and (g),
4-404(c)(2)(viij and (3), 5-404(c)(3) and (4), 6-403(f)(2) and (3), 7-404(f)(2)
and (g), 8-402(c)(3) and (4), and 10-218(e).

In subsection (b)(l)(iv) of this section, the reference to "receiv[ing] all the
service credit" is substituted for the former reference to "be[ing] credited with
all the service" to allow use of the term "service credit" consistent with other
similar provisions in this Division II.

The State Personnel and Pensions Article Review Committee notes, for
consideration by the General Assembly, that in subsection (a)(2) of this
section the prohibition against a retiree's rejoining the State system until the
retiree's salary at least equals the average final compensation at retirement
applies only to the retiree's former State system. The General Assembly may
wish to broaden the provision so that it would apply to any State system that
the retiree may otherwise be required to join.

The State Personnel and Pensions Article Review Committee also notes, for
consideration by the General Assembly, that subsection (c) of this section
does not apply to the State Police Retirement System or the Teachers'
Retirement System even though those State systems appear to be suitable for
inclusion and this section applies to comparable State systems.
