29-118. EFFECT OF WORKERS' COMPENSATION BENEFITS.

(A)     SCOPE OF SECTION.

THIS SECTION APPLIES TO A RETIREE AND ANY DESIGNATED BENEFICIARY.

(B)      REDUCTION IN RETIREMENT ALLOWANCE.

(1)      THE BOARD OF TRUSTEES SHALL REDUCE A DISABILITY
RETIREMENT BENEFIT BY ANY RELATED WORKERS' COMPENSATION BENEFITS PAID
OR PAYABLE AFTER THE EFFECTIVE DATE OF RETIREMENT IF THE WORKERS'
COMPENSATION BENEFITS:

(I)       ARE PAID OR PAYABLE WHILE A PENSION IS PAID OR
PAYABLE; AND

(II)     ARE FOR AN ACCIDENTAL PERSONAL INJURY OR
OCCUPATIONAL DISEASE ARISING OUT OF AND IN THE COURSE OF THE RETIREE'S
EMPLOYMENT BY:

1.        THE STATE, FOR A RETIREE OF THE CORRECTIONAL
OFFICERS' RETIREMENT SYSTEM, THE EMPLOYEES' RETIREMENT SYSTEM, THE
NATURAL RESOURCES PENSION SYSTEM, THE STATE POLICE RETIREMENT SYSTEM,
OR THE TEACHERS' RETIREMENT SYSTEM.

2.        THE STATE OR A PARTICIPATING EMPLOYER FOR A
RETIREE OF THE EMPLOYEES' PENSION SYSTEM OR LOCAL FIRE AND POLICE
SYSTEM; OR

3.        A PUBLIC SCHOOL, FOR A RETIREE OF THE TEACHERS'
PENSION SYSTEM.

(2)      A RETIREMENT ALLOWANCE MAY NOT BE REDUCED TO BE LESS
THAN:

(I) THE RETIREE'S ANNUITY; OR
