1994 LAWS OF MARYLAND

(B) TERMINATION OF SERVICE.
"TERMINATION OF SERVICE" INCLUDES:

(1)      RETIREMENT AT THE AGE OF 70 YEARS AS REQUIRED BY ARTICLE
IV, § 3 OF THE MARYLAND CONSTITUTION;

(2)      VOLUNTARY RETIREMENT;

(3)      RESIGNATION BECAUSE OF DISABILITY;

(4)      RETIREMENT BY ORDER OF THE COURT OF APPEALS;

(5)      RESIGNATION;

(6)      NONELECTION OR NONCONFIRMATION WHEN ELECTION OR
CONFIRMATION IS REQUIRED;

(7)      EXPIRATION OF TERM WITHOUT REAPPOINTMENT; OR

(8)        ABOLITION OF THE MEMBER'S OFFICE.

REVISOR'S NOTE: This subsection is new language derived without substantive
change from former Art. 73B, § 9-101(i).

The reference to "the permanent cessation of active judicial service by a
judge" is deleted as unnecessary.

In item (2) of this subsection, the former references to "reaching the age of 60
years" and "reaching the age of 70 years" are deleted as unnecessary because
the age of retirement does not affect whether the retirement is a "termination
of service". Similarly, in item (3) of this subsection, the former reference to
resignation "before reaching the age of 60 years" is deleted.

In item (5) of this subsection, the former reference to resignation at "any time
for any other reason, or without stating a reason" is deleted as surplusage.

In item (6) of this subsection, the reference to "nonelection or
nonconfirmation" is substituted for the former reference to "not elected or
confirmed at or within the time provided for election or confirmation" for
brevity.

Defined term: "Retirement" § 20-101

REVISOR'S NOTE TO SECTION: Former Art. 73B, § 9-101(b) and (f), which
defined the contributory and noncontributory plans, are deleted as
unnecessary because the provisions on the noncontributory plan have been
transferred to the Session Laws. See General Revisor's Note to this title.
