WILLIAM DONALD SCHAEFER, Governor

Ch. 6

IF THE BOARD OF TRUSTEES PAYS AN ALLOWANCE TO MORE THAN ONE
CHILD, THE BOARD OF TRUSTEES SHALL DIVIDE THE ALLOWANCE AMONG THE
CHILDREN UNDER THE AGE OF 18 YEARS IN A MANNER THAT PROVIDES FOR
PAYMENTS TO CONTINUE UNTIL EACH CHILD DIES OR BECOMES 18 YEARS OLD.

REVISOR'S NOTE: Subsection (a) of this section is new language added for
clarity.

Subsections (b) and (c) of this section are new language derived without
substantive change from former Art. 73B, § 8-404(a).

In subsection (b) of this section the reference to a service retirement
allowance "with or without a supplemental service retirement allowance" is
deleted as surplusage.

In subsection (b)(2) of this section, the word "eligible" which formerly
modified "surviving spouse" is deleted as surplusage.

In subsection (c) of this section, the reference to the Board of Trustees
"dividing] the allowance among the children under the age of 18 years in a
manner that provides for payments to continue until each child dies or
becomes 18 years old" is substituted for the former reference to the division of
the allowance "in a manner as the Board of Trustees determines, to continue
as a joint and survivorship pension for the benefit of the children under 18
years old until every child dies or becomes 18 years old", for clarity and to
conform to other, similar provisions in this Division II.

Defined terms: "Allowance" § 20-101

provided under this subtitle.
