Ch. 6                                            1994 LAWS OF MARYLAND

AND

(1) THIS SUBSECTION APPLIES ONLY TO A MEMBER WHO:

(I) HAS RETIRED UNDER SUBSECTION (B)(1) OF THIS SECTION;

(II) IS UNDER THE AGE OF 62 YEARS.

(2) ON RETIREMENT, A MEMBER SHALL RECEIVE A SUPPLEMENTAL
SERVICE RETIREMENT ALLOWANCE THAT EQUALS THE DIFFERENCE BETWEEN:

(I)       THE MEMBER'S NORMAL SERVICE RETIREMENT ALLOWANCE;

AND

(II)     1.7% OF THE MEMBER'S AVERAGE FINAL COMPENSATION FOR
EACH YEAR OF CREDITABLE SERVICE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 8-401.

In subsections (a), (b), and (c) of this section, the word "normal" is added to
modify "service retirement allowance" to distinguish this type of retirement
allowance from other types of retirement allowance.

26-402. SURVIVOR BENEFITS.                                        

(A) , SCOPE OF SECTION.

THIS SECTION APPLIES TO THE SURVIVING SPOUSE OR A CHILD OF A RETIREE
IN RECEIPT OF A SERVICE RETIREMENT ALLOWANCE OR A DISABILITY
RETIREMENT ALLOWANCE.                                                                                       

(B) BENEFITS TO BE PAID.

ON THE DEATH OF A RETIREE, THE BOARD OF TRUSTEES SHALL PAY 50% OF
THE RETIREE'S RETIREMENT ALLOWANCE TO:

(1)      THE SURVIVING SPOUSE; OR

(2)      IF THERE IS NO SURVIVING SPOUSE OR IF THE SURVIVING SPOUSE
DIES BEFORE THE YOUNGEST CHILD OF THE RETIREE IS 18 YEARS OLD, ALL
CHILDREN OF THE DECEASED RETIREE WHO ARE UNDER 18 YEARS OLD.

(C) CHILDREN'S ALLOWANCE.
