Ch. 6                                       1994 LAWS OF MARYLAND

Subsection (c)(2)(ii) of this section is revised to clarify who must submit the
oath to the office of the Secretary of State and that the oath be immediately
submitted to the Secretary of State, rather than as a requirement that the
Secretary of State immediately file the oath.

In subsection (d)(2) of this section, the language "may complete the term of
office" is substituted for "may not be prevented from completing their terms
of office" to express in positive terms that which only was implied in former
Art. 73B, § 1-103(b)(2)(ii).

Former Art. 73B, § 1-103(b)(1), which required ex officio trustees to serve for
the duration or any extension of their terms in office, is deleted as an
unnecessary restatement of common practice.

The State Personnel and Pensions Article Review Committee notes, for the
consideration of the General Assembly, that there is no provision in this
section for removal of a member of the Board of Trustees other than for
trustees appointed by the Governor.

21-105. SAME — OFFICERS.

THE BOARD OF TRUSTEES SHALL:

(1)      ELECT A CHAIRMAN ANNUALLY FROM ITS MEMBERSHIP; AND

(2)      BY A MAJORITY VOTE OF ALL OF THE TRUSTEES, ELECT A
SECRETARY WHO MAY BE ONE OF ITS MEMBERS.

REVISOR'S NOTE: This section is new, language derived without substantive
change from former Art. 73B, § 1-103(g)(1).

In item (2) of this section, the reference to "elect[ing]" a secretary is
substituted for the former reference to "appoint[ing]" the secretary because
this section requires that the secretary be chosen by a vote of the Board.

The State Personnel and Pensions Article Review Committee notes, for
consideration by the General Assembly, that this section may require a greater
voting majority for the election of the secretary than that required for the
election of the chairman of the Board of Trustees.
