1994 LAWS OF MARYLAND

(3) THE FUND SHALL CONSIST OF THE MONEYS APPROPRIATED,
TRANSFERRED, CREDITED, OR PAID TO IT FROM ANY SOURCE AND MONEYS HELD.

(4) THE STATE TREASURER SHALL, HOLD, AND THE COMPTROLLER
SHALL ACCOUNT FOR, THE FUND.

(5) THE FUND SHALL BE INVESTED AND REINVESTED IN THE SAME
MANNER AS OTHER STATE FUNDS, AND ANY INVESTMENT EARNINGS SHALL BE
RETAINED TO THE CREDIT OF THE FUND.

(C) (1) BEGINNING WITH THE BUDGET FOR FISCAL YEAR 1996, THE ANNUAL
BUDGET SUBMITTED BY THE GOVERNOR AND THE BUDGET BILL ENACTED BY THE
GENERAL ASSEMBLY SHALL INCLUDE THE SUBCABINET RESOURCE FUND AS A
SEPARATE ITEM.

(2) A DEPARTMENT OR AGENCY DESIGNATED BY THE SUBCABINET
SHALL ACT AS THE FISCAL AGENT FOR THE FUND, IN, ACCORDANCE WITH POLICIES
AND PROCEDURES ADOPTED BY THE SUBCABINET.

   (D) THE INTERAGENCY BUDGETING AND FUNDING-SYSTEM SHALL INCLUDE:

(1) GRANTS TO STATE DEPARTMENTS AND LOCAL PLANNING ENTITIES
TO PROVIDE. THE MOST EFFECTIVE AND APPROPRIATE, NONCATEGORICAL
INTEGRATED CARE AND SERVICES FOR CHILDREN AND FAMILIES;

(2)      DEVELOPMENT OF PRIORITIES TO ASSURE FUNDING OF SERVICES
FOR THE CHILDREN AND FAMILIES MOST AT RISK OF OUT OF HOME PLACEMENT
OR WITH THE MOST SERIOUS PROBLEMS;

(3) DEVELOPMENT OF A CONTINUUM OF CARE AND SERVICES THAT IS
FAMILY AND CHILD ORIENTED AND EMPHASIZES PREVENTION, EARLY
INTERVENTION, AND COMMUNITY BASED SERVICES;
                                   

(4) AN INTERAGENCY EFFORT TO MAXIMIZE AVAILABLE RESOURCES
FROM ALL SOURCES, INCLUDING FEDERAL FUNDS AND PRIVATE THIRD PARTY
REIMBURSEMENT, AND A PLAN TO REINVEST ANY ADDITIONAL RESOURCES IN THE
CARE AND SERVICES FOR CHILDREN AND FAMILIES; AND

(5)      THE USE OF OUTCOME MEASURES AND FISCAL, INCENTIVES TO
ENCOURAGE MORE PRODUCTIVE USE OF STATE FUNDS FOR CHILDREN AND
FAMILY SERVICES.

(E) IF THE SUBCABINET RESOURCE FUND DOES NOT HAVE SUFFICIENT
FUNDS TO MEET THE CURRENT NEEDS FOR CHILDREN AND FAMILY SERVICES, THE
SUBCABINET MAY REQUEST A SUPPLEMENTAL OR DEFICIT APPROPRIATION, OR

MAY OBTAIN ADDITIONAL FUNDS FROM THE DEPARTMENTS OF EDUCATION,
HEALTH AND MENTAL HYGIENE, HUMAN RESOURCES, AND JUVENILE SERVICES,
EXCEPT THAT ALL THE DEPARTMENTS MUST CONTRIBUTE FUNDS TO MEETING
SUCH DEFICIT IN AMOUNTS WHICH RECOGNIZE THE DEPARTMENTS' JOINT
RESPONSIBILITY FOR CHILDREN AND FAMILY SERVICES.
