1994 LAWS OF MARYLAND

WHEREAS, Worcester County is a participating governmental unit in the State
Retirement and Pension System and Ocean City has its own pension plan; and               

WHEREAS, Worcester County and Ocean City have agreed to allow the former
employees of the Worcester County Sanitary Commission to continue as members of the
Worcester County Sanitary District Pension Plan; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 73B - Pensions

(D) AN EMPLOYEE OF WORCESTER COUNTY IS NOT ELIGIBLE TO
PARTICIPATE IN THE EMPLOYEES' SYSTEMS UNDER THIS SUBTITLE IF THE
EMPLOYEE:                                                                     

(1)      IS EMPLOYED BY WORCESTER COUNTY ON/JULY 1, 1994;                   

(2)      WAS AN EMPLOYEE OF THE WORCESTER COUNTY SANITARY
COMMISSION ON OCTOBER 31, 1993; AND                                                                             

(3)      IS A. MEMBER OF THE WORCESTER COUNTY SANITARY DISTRICT
PENSION PLAN OR ITS SUCCESSOR.

SECTION 2. AND BE IT FURTHER ENACTED, That Section(s) 31-108 through
31-114, respectively, of Article - State Personnel and Pensions of the Annotated Code of
Maryland be renumbered to be Section(s) 31-109 through 31-115, respectively.

SECTION 3. AND BE IT FURTHER ENACTED, That the Laws of Maryland

AN EMPLOYEE OF WORCESTER COUNTY IS NOT ELIGIBLE TO PARTICIPATE IN

THE EMPLOYEES' SYSTEMS UNDER THIS SUBTITLE IF THE EMPLOYEE:

(1)      IS EMPLOYED BY WORCESTER COUNTY ON JULY 1, 1994;                   

(2)      WAS AN EMPLOYEE OF THE WORCESTER COUNTY SANITARY
COMMISSION ON OCTOBER 31, 1993; AND                                                                             

(3)      IS A MEMBER OF THE WORCESTER COUNTY SANITARY DISTRICT
PENSION PLAN OR ITS SUCCESSOR.

SECTION 4. AND BE IT FURTHER ENACTED, That, notwithstanding any other
provision of law and in accordance with Article 25B, §§ 13E and 13E-1 of the Annotated
Code of Maryland, an individual who was an employee of the Worcester County Sanitary
Commission on October 31, 1993, may continue membership in the Worcester County
Sanitary District Pension Plan or its successor.
