Preamble

WHEREAS, Under Article 25B, § 13E of the Code, code counties, including
Worcester County, have the authority to establish a department of public facilities and
services and are required to abolish a sanitary commission for the county if the water and
sewerage functions of the commission are assigned to the department; and

WHEREAS, Under Article 25B, § 13E-1 of the Code, if a code county assumes the
responsibilities of a sanitary commission, it may enter into an agreement with a municipal
corporation or other local community to transfer responsibility for water and sewerage
services to that municipal corporation or local community; and

WHEREAS, Any employees of sanitary commissions that are abolished in
accordance with Article 25B, §§ 13E and 13E-1 of the Code are to transfer employment
to the code county or the municipal corporation or local community without any loss of
benefits, including retirement benefits; and

WHEREAS, The Worcester County Sanitary Commission dissolved as of November
1, 1993; and

WHEREAS, The County Commissioners of Worcester County have agreed to take
over the responsibilities of the Worcester County Sanitary Commission outside Ocean
City while Ocean City has agreed to take over the responsibilities of the Worcester
County Sanitary Commission in Ocean City as of July 1, 1994; and

WHEREAS, The former employees of the Worcester County Sanitary Commission
became employees of Worcester County as of November 1, 1993; and

WHEREAS, Some of the former employees of the Worcester County Sanitary
Commission will become employees of Ocean City as of July 1, 1994; and
