(b) (1) There shall be a single, statewide institutional educator pay plan for the
positions described under subsection (a) of this section. The pay plan shall be established
by the Institutional Educator Pay Plan Committee as provided in § 6-303.1 of this
subtitle.

(2)     In establishing the pay plan, the Institutional Educator Pay Plan
Committee shall review the salaries of public school teachers, librarians, and
administrators in the six jurisdictions with the highest number of institutional educator
positions and shall set salaries at levels that will be adequate to recruit and retain
qualified institutional educators. The pay plan shall include classifications and pay grades
based on the duties, responsibilities, education, and training required.

(3)      The pay plan established under this subsection shall be provided to the
Secretary of Personnel on or before the June 1 prior to the July 1 of the fiscal year in
which the pay plan will take effect. The Secretary of Personnel shall review the pay plan
within 15 days of receiving it and may recommend changes to the pay plan. The changes
shall be adopted if approved by the Institutional Educator Pay Plan Committee.

(C) BEGINNING WITH FISCAL YEAR 1996 AND IN EACH YEAR THEREAFTER,
THE GOVERNOR SHALL INCLUDE IN THE BUDGET PROPOSAL SUBMITTED TO THE
GENERAL ASSEMBLY THE MONEYS NECESSARY TO FULLY FUND THE SINGLE,
STATEWIDE INSTITUTIONAL EDUCATOR PAY PLAN DEVELOPED BY THE

INSTITUTIONAL EDUCATOR PAY PLAN COMMITTEE IN ACCORDANCE WITH THIS

6-303.1.

(e) (1) IN ACCORDANCE WITH THE RECOMMENDATIONS OF THE
INSTITUTIONAL PAY PLAN COMMITTEE, THE SECRETARY OF PERSONNEL SHALL
MAKE ADJUSTMENTS TO THE INSTITUTIONAL EDUCATOR PAY PLAN TO BE
EFFECTIVE FOR THE FISCAL YEAR BEGINNING ON JULY 1, 1995 TO ENSURE THAT
SALARIES IN THE PAY PLAN ARE ADEQUATE TO RECRUIT AND RETAIN QUALIFIED
INSTITUTIONAL EDUCATORS. [Beginning with the third fiscal year the institutional
educator pay plan is in effect and in
FOR FISCAL YEAR 1999 AND every third fiscal year
thereafter,] ON AN ANNUAL BASIS, the Secretary of Personnel shall adjust the
institutional educator pay plan if necessary to ensure that salaries in the pay plan are
adequate to recruit and retain qualified institutional educators.

(2)      On or before [the] EACH September 1 [preceding the beginning of the
fiscal year for which adjustments to the pay plan may be made under this subsection], the
Institutional Educator Pay Plan Committee shall review the salaries of public school
teachers, librarians, and administrators in the six jurisdictions with the highest number of
institutional educator positions, and shall recommend adjustments to the pay plan to the
Secretary of Personnel.

(3)      (i) The Secretary of Personnel shall furnish a copy of the Department
of Personnel's recommended pay plan to the Secretary of Budget and Fiscal Planning not
later than the October 1 preceding the beginning of the fiscal year for which adjustments
to the pay plan are to be made.
