(ii) The Secretary of Budget and Fiscal Planning shall incorporate
these adjustments into the budget recommendations for the Governor's review and
approval for inclusion in the annual budget request.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October July 1, 1994.

AN ACT concerning

Procurement Law - Minority Business Enterprise - Certification

FOR the purpose of clarifying that a business may. not participate in the minority business
participation program while the business's certification is pending; and requiring
the Board of Public Works to adopt certain regulations.

Section 14-303(c)

Annotated Code of Maryland

(1988 Replacement Volume and 1993 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

14-303.

(C) THE REGULATIONS ADOPTED UNDER THIS SECTION SHALL SPECIFY THAT
A UNIT MAY NOT ALLOW A BUSINESS TO PARTICIPATE AS IF IT WERE A CERTIFIED
MINORITY BUSINESS ENTERPRISE IF THE BUSINESS'S CERTIFICATION IS PENDING.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1994.
