Ch. 467                                        1994 LAWS OF MARYLAND

making a technical correction concerning the application of disciplinary suspension
procedures; making this Act an emergency measure; and generally relating to State
employee grievance and disciplinary suspension
procedures:

BY repealing and reenacting, with amendments,
Article - State Personnel and Pensions
Section 9-401 and 10-101
Annotated Code of Maryland
(1993 Volume)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - State Personnel and Pensions

9-401.

(a)      This subtitle applies [only] to ALL classified service AND UNCLASSIFIED
SERVICE employees IN THE STATE PERSONNEL MANAGEMENT SYSTEM.

(b)      This subtitle does not apply to a suspension pending the disposition of a charge for
removal of a classified service employee.

10-101.

(A)     In this title, "grievance" means a dispute between an employee and the
employee's employer about the interpretation of and application to the employee of:

(1)      a personnel policy or regulation adopted by the Secretary; or

(2)      any other policy or regulation over which management has control.

(B)      "GRIEVANCE" DOES NOT INCLUDE A DISPUTE CONCERNING:

(1)      THE PAY RATE FOR A JOB CLASS;

(2)      THE KIND, EXTENT, OR LEVEL OF FRINGE BENEFITS PROVIDED BY
THE STATE;

(3)     THE AMOUNT OR THE EFFECTIVE DATE OF A STATEWIDE GENERAL
PAY INCREASE; OR

(4)      (3) THE STATE'S PAY SCHEDULE.

SECTION 2.AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 199
4.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act makes a technical
correction in § 9-401 of the State Personnel and Pensions Article of the Annotated Code to
clarify that the provisions of Title 9, Subtitle 4 of the State Personnel and Pensions Article
apply to both classified service employees and unclassified service employees in the State
