(2)      THE REGISTRATION FEE REQUIRED BY PARAGRAPH (1) OF THIS
SUBSECTION SHALL BE SUBMITTED WITH THE REGISTRATION. ANY REGISTRATION
FOR WHICH A REGISTRATION FEE IS REQUIRED BY PARAGRAPH (1) OF THIS
SUBSECTION THAT IS NOT ACCOMPANIED BY THE REQUIRED FEE SHALL SUBJECT
THE LOBBYIST TO THE ENFORCEMENT PROVISIONS AND SANCTIONS AS SET FORTH
IN § 2-105 AND TITLE 7 OF THIS ARTICLE.

(3)      ANY FEES REMITTED TO THE STATE ETHICS COMMISSION
PURSUANT TO THIS SECTION SHALL BE DEPOSITED TO AN ACCOUNT DESIGNATED
FOR USE BY THE COMMISSION IN DEFRAYING THE COSTS OF ADMINISTERING THE
LOBBYING PROVISIONS OF THIS TITLE.

5-107.

(A) (I) THERE IS A LOBBYIST REGISTRATION FUND.

(2) ALL FEES COLLECTED UNDER THE PROVISIONS OF THIS SUBTITLE
SHALL BE CREDITED TO THE FUND.

(B) THE FUND SHALL BE USED TO PARTIALLY DEFRAY THE EXPENSES OF
ADMINISTERING THIS SUBTITLE.

(B) THE FUND ISA CONTINUING, NONLAPSING FUND THAT IS NOT SUBJECT TO §
7-302 OF THE STATE FINANCE AND PROCUREMENT ARTICLE.

(C) (1) THE TREASURER SHALL SEPARATELY HOLD, AND THE COMPTROLLER
SHALL ACCOUNT FOR, THE FUND.

(2) THE FUND SHALL BE INVESTED AND REINVESTED IN THE SAME
MANNER AS OTHER STATE FUNDS.

(D) EXPENDITURES FROM THE FUND SHALL BE MADE IN ACCORDANCE WITH AN
APPROPRIATION APPROVED BY THE GENERAL ASSEMBLY IN THE ANNUAL BUDGET.

(E) THE MONEYS DISTRIBUTED TO THE FUND SHALL BE USED TO SUPPORT THE
EXPENSES OF ADMINISTERING THE MARYLAND PUBLIC ETHICS LAW AS ESTABLISHED IN
THIS SUBTITLE.

SECTION 2. AND BE IT FURTHER ENACTED, That the registration fee
requir
ed by this Act shall be required for any registration filed after the effective date of
this Act by any lobbyist that has at least one an existing registration on file with th
e
Commission during the reporting period during which this Act takes effect.

SECTION 2. AND BE IT FURTHER ENACTED, That, notwithstanding the
provisions of this Act, for Fiscal Year 1995 only, funds collected from the fee may be spent by
approved budget amendment.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
October November 1, 1994.
