The Superintendent may, with the approval of the [Secretary of Public Safety and
Correctional Services] GOVERNOR, designate without examination, to serve at the
Superintendent's pleasure, two of the police employees ONE POLICE EMPLOYEE holding
the highest commissioned rank to be deputy superintendents SUPERINTENDENT. The
deputy superintendents SUPERINTENDENT shall have such authority, responsibility, and
duties as may be assigned by the Superintendent and, in case of the absence from the
State of incapacitating disability of the Superintendent, one of the deputy
superintendents SUPERINTENDENT shall be designated by the Superintendent and shall
have all of the powers and duties conferred by law upon the Superintendent. If the
Superintendent is unable, due to illness, injury or other sudden disability, to de
signate
one of the deputy superintendents to act during the period of incapacitating disability, the
senior deputy
superintendent shall act as the Superintendent DURING THE
SUPERINTENDENT'S ABSENCE OR until the disability is removed. A deputy
superintendent designated in accordance with this section shall, notwithstanding any
other provision of this article, continue in office at the pleasure of the Superintendent.
Upon termination of such designation by the Superintendent, such person shall return to
the rank held prior to such designation. Deputy superintendents THE DEPUTY
SUPERINTENDENT" shall not be paid in accordance with § 23(a) of this article but shall
receive such salary as provided in the budget. Whenever the Superintendent terminates
the designation of a particular person as deputy superintendent, such person shall
thereafter be paid in accordance with § 23(a) of this article.

22.

(a) From and after July 1, 1974, all police employees of the Maryland State Police
shall receive such salary, including any increment based upon length of service, as set
forth in a salary plan proposed by the Superintendent of Maryland State Police [and the
Secretary of Public Safety and Correctional Services] and approved by the Secretary of
Personnel, and provided in the State budget.

23.

(a) The Superintendent of the Maryland State Police shall develop a salary plan
for police employees which shall include such ranks and grades within ranks as he deems
appropriate. The plan shall be effective upon approval by the [Secretary of Public Safety
and Correctional Services] GOVERNOR if sufficient funds therefor are included in the
State budget. No police employee shall be demoted or otherwise affected in rank, pay or
status except for cause as hereinbefore required. A police employee who holds a rank
determined by the Superintendent to be obsolete shall remain in the rank until promoted,
demoted, retired, or otherwise terminated.

SECTION 2. AND BE IT FURTHER ENACTED, That:

(a) All rights, powers, duties, obligations, and functions that were exercised by
and granted to the Maryland State Police prior to the effective date of this Act shall be
transferred to the Department of Maryland State Police on the effective date of this Act.
