Ch. 45

(A) THE County Council for Montgomery County is authorized, empowered and
directed to levy and cause to be collected from the property owners, at the time of the
County Tax Levy for each year, within the described area of the Village of North Chevy
Chase as named or created in this subtitle, such amounts not exceeding fifty cents on each
one hundred dollars worth of assessable property in any part of the Village of North
Chevy Chase, as may be requested by a majority vote of the qualified voters in residence
in the Village of North Chevy Chase present at a meeting called for such purpose by the
Village Council, notice of which meeting shall have been delivered to all such resident
households and owners at least two weeks in advance of the meeting.

(D) Such taxes shall be collected as all county taxes in the county are collected,
and shall be paid over by the County Council to the Treasurer of the Village Council of
the Village of North Chevy Chase, to be selected from among their number by a majority
of the members of the Village council, or by their successors. Upon the Treasurer having
been duly selected by the Village Council and having given corporate bond in
Montgomery County, Maryland, satisfactory to and approved by the County Executive
and the County Attorney in a penal sum to be fixed by them, conditioned upon the
faithful discharge of the duties of the Treasurer, the County Council shall also order and
have paid over to the Treasurer the proportion of the highway user funds to be levied and
collected in the same manner as though that part of the Village of North Chevy Chase
were an incorporated town, and that part of the village shall for that purpose be
considered by the County Council as an incorporated town of the county.

(C) The proportion of the highway user funds received by the Treasurer shall be
used by the Village Council for maintaining and repairing the county roads, streets, and
lanes that may have been dedicated to the public or to Montgomery County, and whether
accepted by the county or not. The Village Council shall use all other funds for opening,
maintaining, repairing, regrading and lighting the streets, roads and alleys, sidewalks,
parking, drainage, sewerage, sanitation and other village maintenance and improvements;
for clerical and other public services; for furnishing police and fire protection; for the
removal of snow, ice, ashes, garbage and other refuse, and disposal thereof; for the
employment of a building inspector to enforce the requirements of all deeds of
conveyance for properties situated in the village; for enforcing such building, sanitary and
other regulations as the Village Council, subject to the County Council's approval, may
prescribe for the Village of North Chevy Chase or for any part of the Village of. North
Chevy Chase.

[SECTION 3. AND BE IT FURTHER ENACTED, that the]

SECTION 3. VILLAGE COUNCIL; TERMS; VACANCIES; OATH OF OFFICE.

(A) THE Village Council of the Village of North Chevy Chase shall consist of five
adult residents of the Village of North Chevy Chase, each of whom shall be elected for
two-year, staggered terms. Two members of the Council shall be elected on the first
[Monday of April] TUESDAY OF MAY during odd-numbered years and three members
shall be elected on the first [Monday of April] TUESDAY OF MAY during
even-numbered years. The election shall be by ballot in a manner to be prescribed by the
Village Council.
