Ch. 45                                      1994 LAWS OF MARYLAND

(B)     Residents of the Village who are registered to vote with the Montgomery
County Board of Supervisors of Elections shall be deemed to be registered to vote in
Village elections. Other Village residents who are qualified to vote in Montgomery
County may register to vote in Village elections.

(C)     All Village residents who are registered to vote in Montgomery County or
Village elections and who have resided in the Village for not less than six months may
hold a Village Council office.

(D)     Following each election, each newly elected member of the Village Council
shall qualify for office by taking an oath to diligently and faithfully discharge all duties of
the office. In case any person shall fail to qualify within thirty days after election as a
councilmember, or in case of any vacancy through death, resignation, or otherwise, the
remaining councilmembers shall fill the vacancy through the appointment of a resident of
the Village who is eligible to hold office. The appointed councilmember shall hold the
office for the remainder of such term or until an election can be held to fill the vacancy,
whichever is shortest.

(E)     The Village Council shall select from its members a chair, a treasurer and any
other officers it may deem necessary.

[SECTION 4. AND BE IT FURTHER ENACTED, That the]

SECTION 4. GENERAL POWERS; SPECIAL ASSESSMENTS.

(A)     THE Village Council of the Village of North Chevy Chase is empowered to
grade, pave, macadamize, or otherwise improve any existing dedicated street, road or
lane, or any county road, street, or lane which has been or which may be acquired and
opened for public use which is ungraded, unpaved, or unimproved, and to lay sidewalks
and curbs thereon, provided that the improvements are petitioned for by the owners of
one half of the frontage abutting on the street, road, lane or sidewalk.

(B)     The Village Council, subject to the approval of the county council, and after
due publication thereof, shall have the power to assess the cost of the grading, paving,
macadamizing, or improving against all property abutting on the street, road, lane or
sidewalk, in proportion to the frontage of the abutting property on the same. Any tax
assessed shall be payable to the County Director of Finance in not more than ten annual
installments, as nearly equal as may be. The first installment shall become due and
payable the first day of July next succeeding the making of such special assessment. Each
installment shall be collected as county taxes are collected, and shall be subject to interest
from the first of the following September until paid at the rate of six per centum per
annum. Each installment of the assessment shall become a lien against the abutting
property, and any installment not paid by the first day of January following its becoming
due, shall be subject to the same penalties and shall be collected in the same manner as
provided for the collection of unpaid county taxes.

(C)     All money received by the County Director of Finance shall, upon order of the
County Council, be paid over to the Treasurer of the Village Council. The Village Council
shall then become charged with the duty to pave, grade, macadamize, or otherwise
improve the streets, roads, lanes, and sidewalks within the Village. Before any contract
for work shall be entered into, or any obligation incurred, notice shall be given to the
