(d) (2) An officer or employee of the State Commission is [not subject to the
State Merit System Law] IN THE UNCLASSIFIED SERVICE OF THE STATE PERSONNEL

MANAGEMENT SYSTEM.

Article - Health Occupations

(d) (2) Staff hired after September 30, 1992 [shall be], ARE IN THE
unclassified SERVICE [employees] OF THE STATE PERSONNEL MANAGEMENT
SYSTEM.

Article - Labor and Employment

2-104.

(a)     (2) The Deputy Commissioner IS IN THE UNCLASSIFIED SERVICE OF THE
STATE PERSONNEL MANAGEMENT SYSTEM AND serves at the pleasure of the
Commissioner.

(b)     (2) The Assistant Commissioner IS IN THE UNCLASSIFIED SERVICE OF
THE STATE PERSONNEL MANAGEMENT SYSTEM AND serves at the pleasure of the
Commissioner.

(c)      (2) The Chief Elevator inspector:

(ii) is subject to the [Merit System Law] PROVISIONS OF THE STATE
PERSONNEL ARTICLE THAT GOVERN CLASSIFIED SERVICE EMPLOYEES.

(d)     (2) The Chief Inspector:

(ii) is subject to the [Merit System Law] PROVISIONS OF THE STATE
PERSONNEL ARTICLE THAT GOVERN CLASSIFIED SERVICE EMPLOYEES.

(e)     (1) [The] SUBJECT TO THE APPROVAL OF THE GOVERNOR, THE
Commissioner may appoint a Chief Mediator [, subject to the approval of the Governor]
WHO SHALL BE IN THE UNCLASSIFIED SERVICE OF THE STATE PERSONNEL
MANAGEMENT SYSTEM.

(f) (2) Each safety inspector:

(I) is entitled to the salary provided in the State budget; AND

(II). IS SUBJECT TO THE PROVISIONS OF THE STATE PERSONNEL
ARTICLE THAT GOVERN CLASSIFIED SERVICE EMPLOYEES.

(g) (1) [The] SUBJECT TO THE APPROVAL OF THE GOVERNOR AND THE
SECRETARY, THE Commissioner may employ, in accordance with the State budget, other
staff needed to perform the duties of the Commissioner [, subject to the approval of the
Governor and the Secretary].
