13-718.

The Authority is exempt:

(3) From the provisions of [Article 64A of the Code] DIVISION I OF THE
STATE PERSONNEL ARTICLE THAT GOVERN THE STATE PERSONNEL MANAGEMENT
SYSTEM.

Article - Health - General

2-103.

(b) (3) [Unless otherwise provided by law, and except] EXCEPT as provided in
paragraph (5) of this subsection OR OTHERWISE BY LAW, the Secretary shall appoint
and remove all other staff in accordance with the provisions of the [State merit system
Law] STATE PERSONNEL ARTICLE THAT GOVERN CLASSIFIED SERVICE EMPLOYEES.

(5) All personnel in the Department, Grade 18 and above, who administer.
or direct a program, shall:

(i) Be [exempt from the State Merit System] IN THE UNCLASSIFIED
SERVICE OF THE STATE PERSONNEL MANAGEMENT SYSTEM; and

(b)      [Each] EXCEPT AS OTHERWISE PROVIDED BY LAW, EACH health officer is
aft IN THE unclassified SERVICE EMPLOYEE IN OF THE State [employee] PERSONNEL
MANAGEMENT SYSTEM.

4-202.

(a) The Secretary shall appoint a State registrar of vital records, who shall be in
the classified service [under the State Merit System Law] OF THE STATE PERSONNEL
MANAGEMENT SYSTEM.

10-408.

(d) In addition to any other power or duty that the Director or Secretary
delegates, the administrative head of a State facility shall:

(2) In accordance with the [State Merit System Law] PROVISIONS OF THE
STATE PERSONNEL ARTICLE THAT GOVERN CLASSIFIED SERVICE EMPLOYEES,
appoint a staff for the State facility as needed and as provided in the State budget; and

(c)     (1) The Superintendent of the Center and each individual in a scientific
position or technical position shall be [an] IN THE unclassified SERVICE [employee of
this State] OF THE STATE PERSONNEL MANAGEMENT SYSTEM.

(2) The remaining administrative employees and all clerical employees shall
be IN THE classified SERVICE employees IN OF THE STATE PERSONNEL MANAGEMENT
SYSTEM.
