Retirement for a correctional officer in the first 6 job classifications or a security
attendant at Clifton T. Perkins Hospital Center is mandatory when the person is 62 years
old. However, year-to-year extensions may be permitted beyond age 62 with the approval
of:

(3) The Secretary of Health and Mental Hygiene for [maximum] security
attendants at Clifton T. Perkins Hospital Center.

Error: Obsolete terminology in Article 73B, § 7-402(3).

Occurred: As a result of Ch. 131, Acts of 1992, in which the word
"maximum", which formerly modified "security attendants", was deleted in
other provisions of Article 73B, Title 7.

(b)     (1) Each retiree shall have a base which shall be the Consumer Price Index
for the calendar year ending December 31 of the fiscal year in which the retiree was last
employed, except that as to any member who deferred retirement in accordance with the
provisions of [§ 7-412] § 7- 411 of this article, the base shall be the Consumer Price
Index for the calendar year ending December 31 of the fiscal year in which the former
member attained the age of 60.

.(c) For the purposes of this section, the allowance referred to in subsection (a) of
this section shall be that allowance elected by the member under [§ 7-411] § 7-407 of
this article, exclusive of any additional voluntary annuity.

(c)     "Earnable compensation" means the normal monthly compensation that is
paid to any employee for working the normal time in the employee's position and that is
equal to one-twelfth of the employee's annual salary rate, including the monthly pickup
contribution, if any, provided for in [§ 1-302(f)(2)] § 1-302(E) of this article.
