Article 83B - Department of Housing and Community Development

1-202.

(b) (4) [Unless] EXCEPT AS otherwise provided by law, all other employees of
the Secretary's office shall be appointed and removed by the Secretary in accordance with
the provisions of [Article 64A of the Code] THE STATE PERSONNEL ARTICLE THAT
GOVERN CLASSIFIED SERVICE EMPLOYEES.

2-202.

(a)     The Secretary, with the approval of the Governor, shall appoint the Director
of the Administration who shall serve at the pleasure of the Secretary. The position of
Director is [not subject to the provisions of Article 64A of this Code] IN THE
UNCLASSIFIED SERVICE OF THE STATE PERSONNEL MANAGEMENT SYSTEM. The
Director shall operate and exercise the powers of the Administration under the direction
of the Secretary in accordance with the provisions of this subtitle. The Director shall
receive such salary and have such deputies, assistants, employees and professional
consultants as provided in the State budget.

(b)     The director shall serve at the pleasure of the Commissioners, subject to the
concurrence of the Secretary, and shall be [an] IN THE unclassified SERVICE
[employee] of the State PERSONNEL MANAGEMENT SYSTEM.

5-405.

(b)    The administrator shall serve at the pleasure of the Commissioners, subject to
the concurrence of the Secretary, and shall be [an] IN THE unclassified SERVICE
[employee] of the State PERSONNEL MANAGEMENT SYSTEM.

5-609.

(e) Positions with the Trust are IN THE unclassified SERVICE OF THE STATE
PERSONNEL MANAGEMENT SYSTEM.

Article 83C - Juvenile Services

2-103.

(c)     (2) [Unless otherwise provided by law and except] EXCEPT as provided in
paragraph (4) of this subsection OR OTHERWISE BY LAW, the Secretary shall appoint
and remove all [other] staff in accordance with the provisions of the [State Merit System
Law] THE STATE PERSONNEL ARTICLE THAT GOVERN CLASSIFIED SERVICE
EMPLOYEES.

(4) All personnel in the Department specified in this paragraph shall be
[exempt from the State Merit System] IN THE UNCLASSIFIED SERVICE OF THE STATE
PERSONNEL MANAGEMENT SYSTEM and shall be appointed by[,] and serve at the
pleasure of the Secretary:

(i) Any assistant secretary;
