(ii) Any director of an institution; and
(iii) The Superintendent of the youth centers.
Article 88A - Social Services Administration

(b) (1) The State Director shall devote his whole time to the duties of his office,
and shall serve as the administrative head of the State Administration, responsible for the
appointment, under the provisions of [Article 64A of this Code] DIVISION I OF THE
STATE PERSONNEL ARTICLE, of all State Administration personnel.
(2) The State Director is responsible for the organization and
administration of the State Administration and for the supervision of local departments,
and other agencies and institutions under the supervision of the State Administration,
subject, to. the rules and regulations prescribed in accordance with law and to the State
and federal Jaws governing the administration of social services and public assistance.
(d) (1) The State Director may appoint such employees as a proper
performance of the duties of the State Department may require, as provided from time to
time in the budget.
(2) [The] EXCEPT AS OTHERWISE PROVIDED BY LAW, appointment and
removal of all paid personnel under this article shall be [governed by] SUBJECT TO the
provisions of [Article 64A of this Code] THE STATE PERSONNEL ARTICLE THAT
GOVERN CLASSIFIED SERVICE EMPLOYEES.
87.
The Department of Employment and Social Services, in the administration of a
program of community home care services for the elderly, and to the extent possible, shall
afford training to, and utilize, elderly persons to perform community home care services.
The elderly persons compensated for their services under this program are not subject to
any of the provisions [of] GOVERNING the [State merit system under Article 64A of this
Code] STATE PERSONNEL MANAGEMENT SYSTEM or the provisions [of] GOVERNING
any merit system of a political subdivision. The Department has sole authority for
determining all conditions of employment and rates of compensation.
Article 88B - State Police

The following words shall have the meanings contained in this section unless the
context manifestly indicates a different meaning:
[(6) "Merit System" means the Merit System Law as established and administered
pursuant to Article 64A of this Code, and includes all provisions of said article.]
