5.

(a) In this section, "State employees" means those officers and employees of the
State of Maryland who are paid through the Central Payroll Bureau or are authorized to
be paid through the Central Payroll Bureau pursuant to [§ 38A of Article 64A] TITLE 6,
SUBTITLE 4 OF THE STATE PERSONNEL ARTICLE. It includes members of the General
Assembly, judges of the Court of Appeals, the Court of Special Appeals, the various
circuit courts, the District Court, the Maryland Tax Court, and the various orphans'
courts, and part-time and contractual employees paid through the Central Payroll Bureau
[by § 38A of Article 64A] UNDER TITLE 6, SUBTITLE 4 OF THE STATE PERSONNEL
ARTICLE, the clerks of the courts in all counties and Baltimore City and all employees in
the office of the clerks of courts, registers of wills in all counties and Baltimore City and
all employees in the Office of the Register of Wills, and all contractual employees of the
State of Maryland, whether or not they are paid through the Central Payroll Bureau or
authorized to be paid through the Central Payroll Bureau [by § 38A of Article 64A]
UNDER TITLE 6, SUBTITLE 4 OF THE STATE PERSONNEL ARTICLE. It includes
employees of the Northeast Maryland Waste Disposal Authority. In cases of doubt as to
whether a person is eligible for participation in the Deferred Compensation Plan
authorized by this section, the Board of [Trustees shall determine whether any person is
a State employee as defined in Compensation Plan authorized by this section, the Board

Article 78 - Public Service Commission Law

17.

(a)     Except as provided in SUBSECTION (b) OF THIS SECTION OR OTHERWISE BY
LAW, all personnel of the Commission shall be subject to [and included in the merit
system established under Article 64A of this Code] THE PROVISIONS OF THE STATE
PERSONNEL ARTICLE THAT GOVERN CLASSIFIED SERVICE EMPLOYEES.

Article 83A - Department of Economic and Employment Development

(b)     (4) [All] EXCEPT AS OTHERWISE PROVIDED BY LAW, ALL other
employees of the Secretary's office [, unless otherwise provided by law,] shall be
appointed and removed by the Secretary in accordance with the provisions of [Article
64A of the Annotated Code of Maryland] DIVISION I OF THE STATE PERSONNEL
ARTICLE THAT GOVERN THE STATE PERSONNEL MANAGEMENT SYSTEM CLASSIFIED
SERVICE EMPLOYEES.

The Division is empowered to employ such employees as its business may require
within limits of its appropriation, subject to the provisions of [Article 64A of this Code]
