4-201.

(f) (1) A permanent employee of the boards of supervisors of elections of a
county or in Baltimore City shall become a member of this pension system as a condition
of employment, except for a board employee who [elects to remain] REMAINS in the
local merit system under FORMER Article 64A, § 9G of the Code.                     

4-302.                                                                                                                

(c) (6) A STATE EMPLOYEE WHO CAME INTO THE STATE SYSTEM WHILE
RETAINING SICK LEAVE AND ANNUAL LEAVE BENEFITS UNDER A COUNTY SYSTEM
AND WHO CAME UNDER THE PROVISIONS OF CHAPTER 423 OF THE ACTS OF. 1971
SHALL BE ENTITLED TO THE SAME FULL CREDIT TOWARD RETIREMENT AS
PROVIDED BY THIS SUBSECTION.                                                   

11-101.

(b) "Eligible employee" means any person who is a member of or eligible for
membership in the Employees' Retirement System, the Pension System for Employees of
the, State of Maryland, the Teachers' Retirement System, or the Pension System for the
Teachers of the State of Maryland and who is:                                                                  

(4) A person who:

(i) Is employed by Morgan State University or St. Mary's College of
Maryland; and

(ii) [Who is not subject to the Merit System Law] IS AN
UNCLASSIFIED EMPLOYEE.

Article 73G - State Supplemental Compensation Plans

2.                                                                                                                                   

(e) (1) [Employees] EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS
SUBSECTION OR OTHERWISE BY LAW, EMPLOYEES of the Board shall be classified
SERVICE employees subject to the provisions of [Article 64A], THE STATE PERSONNEL
ARTICLE THAT GOVERN CLASSIFIED SERVICE EMPLOYEES.

(2) [, except for employees] EMPLOYEES holding positions designated by
the Board of Trustees as professional or technical positions that involve specialized skill,
education, and knowledge, and whose labor is predominately intellectual rather than
physical or manual SHALL BE IN TOE UNCLASSIFIED SERVICE OF THE STATE
PERSONNEL MANAGEMENT SYSTEM.

4.

(a) This section applies only to CLASSIFIED SERVICE employees [as defined in §
1 of Article 64A] IN THE STATE PERSONNEL MANAGEMENT SYSTEM.
