(iii) The Executive Director shall report annually on or before January
31, subject to § 2-1312 of the State Government Article, to the General Assembly and to
the Secretary of Personnel setting forth all staff positions, classifications, and salaries in
the Fund as of the preceding calendar year end.

Article 70B - Office on Aging

(c) (1) Any [person] INDIVIDUAL 70 years old or older is eligible for
appointment to any permanent [merit system] CLASSIFIED SERVICE position IN THE
STATE PERSONNEL MANAGEMENT SYSTEM for which [he] THE INDIVIDUAL qualifies,
and the appointment is subject to the provisions of [Article 64A] THE STATE
PERSONNEL ARTICLE THAT GOVERN CLASSIFIED SERVICE EMPLOYEES.

(2) Any [person] INDIVIDUAL who is first appointed to a permanent
[merit system] CLASSIFIED SERVICE position or unclassified SERVICE position at the
age of 70 or older shall not be eligible for membership in the pension systems of the State.

Article 73B - Pensions

1-104.

(c) (1) The Executive Director shall appoint the employees provided for in the
budget.

(2)      [The] EXCEPT AS PROVIDED IN PARAGRAPH (3) OF THIS
SUBSECTION OR OTHERWISE BY LAW, THE staff shall be classified SERVICE employees
subject to the provisions of [Article 64A of the Code] THE STATE PERSONNEL ARTICLE
THAT GOVERN CLASSIFIED SERVICE EMPLOYEES; [, except for employees],

(3)      EMPLOYEES who hold positions that are designated by the Executive
Director, with the approval of the Board of Trustees, as professional or technical
positions that involve specialized skill, education, and knowledge, and whose labor is
predominantly intellectual rather than physical or manual, ARE IN THE UNCLASSIFIED
SERVICE OF THE STATE PERSONNEL MANAGEMENT SYSTEM.

(b) All full-time and part-time permanent employees of the boards of supervisors
of elections of the counties and in Baltimore City became members of the Employees'
Retirement System of the State of Maryland as a condition of employment, except those
board employees who [elected to remain] REMAINED in the local merit system under
the provisions of [§ 9G] FORMER Article 64A, § 9G of [this] THE Code.

[3-302.1 2-302.

(f) A State employee who came into the State system while retaining sick leave
and annual leave benefits under a county system and who came under the provisions of
Chapter 423 of the Acts of 1971 shall be entitled to the same full credit toward retirement
as provided by this section.
