(7) To appoint, with the approval of the Secretary of Public Safety and
Correctional Services, an executive director WHO SHALL BE IN THE UNCLASSIFIED
SERVICE OF THE STATE PERSONNEL MANAGEMENT SYSTEM [, to] AND SHALL serve
at [its] THE pleasure OF THE COMMISSION, [who shall] perform general administrative
functions, and [to fix his] RECEIVE THE compensation SET BY THE COMMISSION;

(d) The Commission:
(9) Shall appoint, with approval of the Secretary of Public Safety and
Correctional Services, an Executive Director WHO who SHALL BE IN THE
UNCLASSIFIED SERVICE OF THE STATE PERSONNEL MANAGEMENT SYSTEM, [who]
AND shall serve at the pleasure of the Commission, perform such administrative functions
as the Commission shall direct, and receive a salary as provided in the budget.

(a) The Commission shall appoint the staff necessary to perform its duties.
However, the activities of the staff may not duplicate or conflict with the functions and
services of the Division of Parole and Probation. [The] EXCEPT AS OTHERWISE
PROVIDED BY LAW, THE staff shall be subject to the provisions of the [Merit System
Law] STATE PERSONNEL ARTICLE THAT GOVERN CLASSIFIED SERVICE EMPLOYEES.

(a) (2) (i) "Employee" means [a person] AN INDIVIDUAL employed in [the
classified service or the unclassified service as defined in Article 64A, Section 1 of the
Code] THE STATE PERSONNEL MANAGEMENT SYSTEM or [a person employed] in any
other authorized personnel system established for a unit of State government.

(f) Beginning January 1, 1992, the creation and filling of all [classified SERVICE
positions shall be in accordance with [Article 64A of the Annotated Code of Maryland
and rules adopted under that article] THE PROVISIONS OF THE STATE PERSONNEL
ARTICLE THAT GOVERN CLASSIFIED SERVICE EMPLOYEES.

(b) (I) The Secretary of Human Resources shall also have attached to the
Secretary's office such assistants, professional consultants, and employees as are provided
for in the State budget. The Secretary may establish areas of responsibility within the
Secretary's office and designate assistants to be in charge of such areas.
(II) All staff assistants in the Secretary's office in charge of particular areas
of responsibility [,] and all professional consultants SHALL BE IN THE UNCLASSIFIED
SERVICE OF THE STATE PERSONNEL MANAGEMENT SYSTEM AND shall serve at the
pleasure of the Secretary.
