(III) [All] EXCEPT AS OTHERWISE PROVIDED BY LAW, ALL other
employees of the Secretary's office [, unless otherwise provided by law,] shall be
appointed and removed by the Secretary in accordance with the provisions of [Article
64A of the Annotated Code of Maryland] THE STATE PERSONNEL ARTICLE THAT
GOVERN CLASSIFIED SERVICE EMPLOYEES.

(c) (1) The Administration may employ professional, technical, clerical,
stenographic, and other personnel to carry out its duties and functions within the limits of
budgetary appropriations from time to time.

(2)      (I) [The] EXCEPT AS PROVIDED IN SUBPARAGRAPH (II) OF THIS
PARAGRAPH OR OTHERWISE BY LAW, THE employees of the Administration [, except
the Director and deputy director,] shall be subject to the provisions [contained in Article
64A of Code, title "Merit System."] OF THE STATE PERSONNEL ARTICLE THAT
GOVERN CLASSIFIED SERVICE EMPLOYEES.

(II) THE DIRECTOR AND THE DEPUTY DIRECTOR ARE IN THE
UNCLASSIFIED SERVICE OF THE STATE PERSONNEL MANAGEMENT SYSTEM.

(3)      Any employee of the Administration who is eligible for transfer to the
[State Merit System,] CLASSIFIED SERVICE and who has held this position for at least
six (6) months, shall be so transferred without further probation, examination, or
qualification. An employee transferred to the [State Merit System,] CLASSIFIED
SERVICE, pursuant to this subsection shall be transferred in the respective job
classification under which be THE EMPLOYEE is employed at the time of transfer and
shall not receive any diminution in compensation and/or respective amounts of
accumulated leave or sick leave, solely as a result of this transfer.
