[(1)] 1. [graduation] GRADUATION from an accredited college or
university, with specialized study in either the field of fire protection or engineering [,];
and
[(2)] 2. [five] FIVE years of recent progressively responsible experience in
fire prevention inspection, fire investigation, fire safety promotion, fire protection
engineering, teaching fire safety engineering, or fire fighting, three years of which must
have been at the administrative level.

(bb) "Public official" means:
(1) Any individual in an executive agency, including an individual employed
on a full-time contractual basis for more than 6 months, who:
(i) Is a classified SERVICE employee at grade level 16 or above, or, if
not a classified SERVICE employee, receives a rate of compensation equal thereto, or is
appointed to a board or commission; and

(b) (1) The Secretary of Public Safety and Correctional Services shall also have
attached to [his] THE SECRETARY'S office such assistants, professional consultants and
employees as are provided for in the State budget. [He] THE SECRETARY may establish
areas of responsibility within [his] THE SECRETARY'S office and designate assistants to
be in charge of such areas.
(2) All staff assistants in the Secretary's office in charge of particular areas
of responsibility [,] and all professional consultants shall BE IN THE UNCLASSIFIED
SERVICE OF THE STATE PERSONNEL MANAGEMENT SYSTEM AND SHALL serve at the
pleasure of the Secretary.
(3) [All] EXCEPT AS OTHERWISE PROVIDED BY LAW, ALL other
employees of the Secretary's office [, unless otherwise provided by law,] shall be
appointed and removed by the Secretary in accordance with the provisions of [Article
64A of the Annotated Code of Maryland] THE STATE PERSONNEL ARTICLE THAT
GOVERN CLASSIFIED SERVICE EMPLOYEES.

(e) Subject to the authority of the Secretary of Public Safety and Correctional
Services, the Commission is vested with the following powers, authority, responsibilities,
and duties:
