AN ACT concerning

Secondhand Personal Property Dealers
Secondhand Precious Metal Object Dealers and Pawnbrokers

FOR the purpose of requiring secondhand personal property dealers who deal in certain
secondhand personal property to be licensed by the Secretary of Licensing and
Regulation as dealers; providing a certain exemption from licensing; authorizing the
Secretary of Licensing and Regulation to deny a license to act as a secondhand
precious metal object dealer or pawnbroker or to discipline a licensee if an
applicant, licensee, or certain employee pleads guilty or nolo contendere or receives
probation before judgment with respect to certain criminal acts; requiring
secondhand personal property dealers pawnbrokers to keep certain records; and
generally relating to licensing of secondhand precious metal object dealers and
secondhand personal property dealers pawnbrokers.

BY repealing and reenacting, with amendments,

Section 12-101, 12-102, 12-201, 12-209(a)(2), 12-209(a)(2) and 12-301; and
12-601, to be under the amended title "Title 12. Secondhand Precious Metal
Object and Secondhand Personal Property Dealers and Pawnbrokers"

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Business Regulation

Title 12. Secondhand Precious Metal Object AND SECONDHAND PERSONAL
PROPERTY Dealers and Pawnbrokers

12-101.

(a) In this title the following words have the meanings indicated.

(b) (1) "Dealer" means an individual who acquires commercially from the
public or trades commercially with the public in secondhand precious metal objects OR
SECONDHAND PERSONAL PROPERTY or, unless otherwise provided, a pawnbroker.

(2) "Dealer" includes:

(I) a retail jeweler as to transactions in which the retail jeweler
acquires commercially from the public or trades commercially with the public in
secondhand precious metal objects; AND

(II) A SECONDHAND PERSONAL PROPERTY DEALER.
