(B) UNLESS AUTHORIZED UNDER THIS TITLE TO PROVIDE BACKFLOW
PREVENTION SERVICES, A PERSON MAY NOT REPRESENT TO THE PUBLIC, BY USE OF
A TITLE, INCLUDING "BACKFLOW PREVENTER TECHNICIAN", "CERTIFIED
BACKFLOW PREVENTER TECHNICIAN", OR "HOLDER OF A BACKFLOW PREVENTER
TECHNICIAN CERTIFICATE", BY DESCRIPTION OF SERVICES, METHODS, OR
PROCEDURES, OR OTHERWISE, THAT THE PERSON IS AUTHORIZED TO PROVIDE
BACKFLOW PREVENTION SERVICES IN THIS STATE.

(a) (1) In this subsection, "officer" includes a superintendent, manager, and
agent of a corporation regardless of whether it engages in the business of providing
plumbing services.
(2) A person, including an officer, who violates any provision of the
following sections of this subtitle is guilty of a misdemeanor and on conviction is subject
to a fine not exceeding $50 for each day or part of each day that the violation continues:
(i) § 12-602;
(ii) § 12-603; and
(ii) § 12-604.
(b) A person who violates any provision of the following sections of this subtitle is
guilty of a misdemeanor and on conviction is subject to a fine not exceeding $100 or
imprisonment not exceeding 6 months or both for each day or part of each day that the
violation continues:
(1) § 12-601;
(2) § 12-605; and
(3) § 12-606.
(c) Any person who knowingly and willfully violates any provision of § 12-501(a)
of this title is guilty of a misdemeanor and on conviction is subject to a fine not exceeding
$1,000 or imprisonment not exceeding 6 months or both.
SECTION 2. 3. AND BE IT FURTHER ENACTED, That Section 2 of this Act
shall take effect October 1, 1994 and shall be construed prospectively only and may not be
applied or interpreted to have any effect upon or application to any journey plumber
license or master plumber license issued before the effective date of this Act October 1,
1994, or to any application for a journey plumber license or master plumber license filed
before the effective date of this Act October 1, 1994.
SECTION 3. 4. AND BE IT FURTHER ENACTED, That Section 1 of this Act
shall take effect October 1, 1994 1993.
