BY repealing and reenacting, with amendments,

Article 16A - Maryland Emergency Management Agency

Section 9(b)

Annotated Code of Maryland

(1990 Replacement Volume and 1992 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 16A - Maryland Emergency Management Agency

6D.

(A)     WHEN AN EMERGENCY HAS BEEN DECLARED IN ANOTHER STATE, THE
GOVERNOR OF THIS STATE, UPON RECEIPT OF A WRITTEN REQUEST FOR
ASSISTANCE FROM THE EXECUTIVE AUTHORITY OF THE OTHER STATE, MAY:

(1)      AUTHORIZE UTILIZATION IN THE STATE REQUESTING ASSISTANCE
OF PERSONNEL, EQUIPMENT, SUPPLIES, OR MATERIALS OF THIS STATE, OR OF A
POLITICAL SUBDIVISION OF THIS STATE, IN THE STATE REQUESTING ASSISTANCE
WITH THE CONSENT OF ITS EXECUTIVE OFFICER OR GOVERNING BODY; AND

(2)      SUSPEND THE PROVISIONS OF ANY STATUTE, OR ANY RULE- OR
REGULATION OF ANY STATE OR LOCAL AGENCY ANY STATE AGENCY, OR AN
AGENCY OF A POLITICAL SUBDIVISION AFTER CONSULTATION WITH ITS EXECUTIVE
OFFICER OR GOVERNING BODY, IF THE GOVERNOR FINDS THAT THE SUSPENSION IS
NECESSARY TO AID THE OTHER STATE WITH ITS EMERGENCY MANAGEMENT
FUNCTIONS.

(B)      AUTHORIZATION FOR UTILIZATION OF RESOURCES OF THIS STATE, OR
OF A POLITICAL SUBDIVISION OF THIS STATE, IN ANOTHER STATE OR SUSPENSION
OF THE PROVISIONS OF ANY STATUTE, RULE, OR REGULATION UNDER THIS
SECTION SHALL BE DECLARED BY EXECUTIVE ORDER OF THE GOVERNOR.

(C)      AN EXECUTIVE ORDER ISSUED UNDER THIS SECTION:

(1)      MAY CONTINUE FOR NO LONGER THAN 30 DAYS UNLESS RENEWED
BY THE GOVERNOR;

(2)      SHALL INDICATE THE NATURE OF THE EMERGENCY IN THE OTHER
STATE;

(3)      IF APPLICABLE, SHALL INDICATE THE CIRCUMSTANCES THAT MAKE
SUSPENSION OF THE PROVISIONS OF ANY STATUTE, RULE, OR REGULATION
NECESSARY TO AID THE OTHER STATE WITH ITS EMERGENCY MANAGEMENT
FUNCTIONS; AND

(4)      SHALL BE DISSEMINATED PROMPTLY BY MEANS CALCULATED TO
BRING ITS CONTENTS TO THE ATTENTION OF THE GENERAL PUBLIC AND FILED
PROMPTLY WITH THE MARYLAND EMERGENCY MANAGEMENT AGENCY, THE STATE
